NOVAtime agreed to pay $4.2 million to resolve claims its biometric timekeeping clocks failed to comply with Illinois privacy laws.

The settlement benefits individuals who scanned their finger or hand on a NOVAtime-branded finger- or hand-scan time clock in Illinois between Aug. 14, 2014, and Oct. 19, 2020.

Plaintiffs in the privacy class action lawsuit claim NOVAtime’s time clocks violated Illinois’ Biometric Information Privacy Act (BIPA). BIPA requires companies to obtain consent and provide notices before collecting and storing biometrics such as fingerprints and hand scans.

NOVAtime was a timekeeping system that UKG acquired in 2021.

NOVAtime hasn’t admitted any wrongdoing but agreed to a $4.2 million settlement to resolve the BIPA class action lawsuit.

Under the terms of the settlement, class members can receive an equal share of the net settlement fund. Each claimant is estimated to receive around $248.90, though actual payments may be higher or lower depending on the number of claims filed.

There is no exclusion or objection deadline for the settlement.

The final approval hearing for the settlement is scheduled for June 26, 2024.

To receive a settlement payment, class members must submit a valid claim form by May 30, 2024.
