CallCore Media agreed to pay $2 million to resolve claims it placed prerecorded phone calls to consumers in violation of state laws and the federal Telephone Consumer Protection Act (TCPA).
The settlement benefits a TCPA class of individuals who received prerecorded phone calls placed by or on behalf of CallCore, whose information was obtained from PHBC Marketing LLC, and the calls were transferred to CallCore.
The settlement also benefits a class of consumers who had a Texas address and/or area code who received calls placed by or on behalf of CallCore, whose information was obtained from PHBC Marketing LLC, and the calls were transferred to CallCore.
Plaintiffs in the class action lawsuit claim that CallCore Media contacted them with unsolicited telemarketing calls that used a prerecorded or artificial voice. According to the plaintiffs, these calls were placed without their consent in violation of the TCPA and the Texas Solicitation Act.
CallCore Media is a direct-to-consumer marketing company.
CallCore Media hasn’t admitted any wrongdoing but agreed to a $2 million settlement to resolve the telemarketing class action lawsuit.
Under the terms of the settlement, class members can receive a pro rata payment of around $120. Class members who resided in Texas or had a phone number with a Texas area code at the time CallCore’s records reflect a call was placed to them can receive an extra 10%, or around $12, in addition to their $120 payments. This payment amount is an estimate based on past claims rates and may be higher or lower depending on the number of claims filed.
The deadline for exclusion and objection is May 21, 2024.
The final approval hearing for the CallCore Media settlement is scheduled for June 25, 2024.
In order to receive a settlement payment, class members must submit a valid claim form by June 19, 2024.
Who’s Eligible
Individuals who received prerecorded phone calls placed by or on behalf of CallCore, whose information was obtained from PHBC Marketing LLC, and the calls were transferred to CallCore.
