Navient agreed to a $16 million settlement to resolve a class action lawsuit claiming that student loan debt owned by the company should have been dischargeable during bankruptcy.

The settlement benefits borrowers or co-borrowers of Navient-owned student loans who filed for bankruptcy protection after Oct. 17, 2005, after they became obligated to repay their student loans and who have never reaffirmed their private student loans.

Plaintiffs in the student loan bankruptcy class action lawsuit claim Navient should have discharged certain student loans after borrowers declared bankruptcy. Borrowers and co-borrowers allegedly suffered from financial damages when their student loans were not discharged.

Navient is a private student loan company that offers financing and loan servicing. 

Navient hasn’t admitted any wrongdoing but agreed to a $16 million settlement to resolve the student loan bankruptcy class action lawsuit.

Under the terms of the settlement, class members can submit a claim for damages they suffered including student loan payments made after bankruptcy filing. Class members could receive between 20% and 100% of the damages they sustained.

Navient also agreed to forgo the collection of certain outstanding balances. This may be entire loan balances or partial balances. The company will also delete or update all trade lines at credit reporting agencies related to these forgiven debts. According to the settlement website, this debt relief is valued at $182.4 million. 

The deadline for exclusion and objection is Nov. 13, 2023.

The final approval hearing for the settlement is scheduled for Dec. 13, 2023.

In order to receive a settlement payment, class members must submit a valid claim form by Nov. 20, 2023.

    I have a student loan also with them back from 1986 for 2400 hundred was paying them. Went in bankruptcy in2015. Now they have a payment three times that a mount on my credit report. What I’m i to do about this

    I don’t have the Unique ID and PIN. When I called this morning to get it, I was told I wasn’t on the list. I should have been on this list because I filed for bankruptcy in 2015 and the student loans were not included in the bankruptcy. How can I get this ID and PIN? Thanks

    I called the admisstrator because I didn’t get a notice. I went bankrupt twice on this student loan, wasn’t allowed to even though it was listed. I met all the criteria of this lawsuit. The administrator said I wasn’t in the list. I’ve paid this loan originally 4200$, which is now 23000$ at least 3 times over. It’s from 1988. I’ve argued with navient over this Several times. As a matter of fact during covid they turned it over to delta magmt and garnished my wages 7000$, then they turned it backi to navient and my bill went right back up to 23000$ that day! Like I had paid nothing but fees and interest to delta management. I am so tired of this. It should have been paid at least 3 or 4 times by now. I am totally being ripped off or scammed. I can’t keep track anymore. I have been actively arguing with navient about this and am getting no response about this suffering and money gauging I’ve been paying. I feel that it doesn’t do any good to pay them so I’m not now.
