Enhanced Recovery Co. agreed to a $450,000 settlement to resolve claims that it violated debt-collection laws with misleading letters.

The class is made up of individuals who received a debt collection letter from Enhanced Recovery Co. that promised to settle the account but said that residual balances would remain with the creditors.

According to the class action lawsuit, Enhanced Recovery violated state and federal laws by sending misleading debt-collection letters. These letters allegedly promised that the company could settle a consumer’s debts while also claiming that the creditor would retain the residual balance. 

Enhanced Recovery Co. is a debt-collection agency that offers both first-party and late-stage collections services.

Enhanced Recovery hasn’t admitted any wrongdoing but agreed to a $450,000 settlement to resolve the class action lawsuit. 

Under the terms of the settlement, class members can receive an equal share of the net settlement fund. Exact payments will vary depending on the number of participating claimants, but class counsel estimates that each claimant will receive around $25. 

The deadline for exclusion and objection is Oct. 24, 2023. 

The final approval hearing is scheduled for Nov. 21, 2023. 

In order to receive a payment, class members must submit a valid claim form by Nov. 23, 2023.
