Navient agreed to a $16 million settlement to resolve a class action lawsuit claiming that student loan debt owned by the company should have been dischargeable during bankruptcy.

The settlement benefits borrowers or co-borrowers of Navient-owned student loans who filed for bankruptcy protection after Oct. 17, 2005, after they became obligated to repay their student loans and who have never reaffirmed their private student loans.

Plaintiffs in the student loan bankruptcy class action lawsuit claim Navient should have discharged certain student loans after borrowers declared bankruptcy. Borrowers and co-borrowers allegedly suffered from financial damages when their student loans were not discharged.

Navient is a private student loan company that offers financing and loan servicing. 

Navient hasn’t admitted any wrongdoing but agreed to a $16 million settlement to resolve the student loan bankruptcy class action lawsuit.

Under the terms of the settlement, class members can submit a claim for damages they suffered including student loan payments made after bankruptcy filing. Class members could receive between 20% and 100% of the damages they sustained.

Navient also agreed to forgo the collection of certain outstanding balances. This may be entire loan balances or partial balances. The company will also delete or update all trade lines at credit reporting agencies related to these forgiven debts. According to the settlement website, this debt relief is valued at $182.4 million. 

The deadline for exclusion and objection is Nov. 13, 2023.

The final approval hearing for the settlement is scheduled for Dec. 13, 2023.

In order to receive a settlement payment, class members must submit a valid claim form by Nov. 20, 2023.

    I have already paid off more than I borrowed and they still expect another 10 grand.ridiculous. never found to be in the wrong for charging interest upon interest so why isn’t that loan amount being written off it makes no sense

    I don’t qualify for this settlement but I can tell you that they are a predatory lender. They’ve called upwards of 10x In one day just to tell me that my payment is late. And they have no long term programs to help you pay your loan easier. They just want their money or they will threaten you and your co-signer. That’s another thing. They threaten my elderly mother who is the co-signer with taking her home away from her if I don’t pay. It’s ruined our relationship.

    I also went to ITT Tech, the scam school! They never taught enough Paralegal information, they also never found me a job, if they would have, I would have been disbarred before I even had a chance for lack of info. I signed up for the lawsuit as my dept is outrageous. I have the hardship where I pay nothing for 10 yrs. Please wipe out my debt!!

    I filed for bankruptcy in 2017, and I got 2 different loans with navient for the same school, and I was never able to get a job with a respectable company because of the school I went to.

    They made the most unreasonbable repayment plans and I was unable to maintain paying them and had to keep deferring my payments.

    Add me please! I had wages garnished from my paycheck and our tax return in the midst of 2020 Covid-19, I gave birth to a baby in January 2020 and had no paid maternity leave—that sucked! They say I owe them again—no idea what’s going on
