Details: The mobile content class action lawsuit was filed on behalf of wireless subscribers who were charged for mobile content that they did not authorize. Over 10 similar lawsuits were filed against Motricity, the wireless carriers, third-party merchants and marketers, and other companies, and are pending in state and federal courts throughout the country. This particular settlement is for the class action lawsuit entitled Williams v. Motricity, Inc.
According to the Williams v. Motricity class action lawsuit, mobile content providers Flycell, Glomobi Mobilefunster, Thumbplay, WebAMG Holding and marketing affiliate Glispa and the aggregator Motricity charged wireless subscribers for “mobile content” without authorization. “Mobile content” includes electronic products such as ringtones, games, graphics, news and other alerts that are provided through mobile phones and are charged directly to users’ mobile phone bills. Cell phone users are encouraged to scan their past phone records for short codes that identify charges from the various mobile content companies. A list of these short codes can be found at www.CellContentSettlement.com.
As part of the mobile content class action lawsuit settlement, Motricity, Flycell, Thumbplay, Glomobi, Funmobile, CSW Group and WebAMG Holdings have agreed to create $10.85 million settlement fund. If you were charged for unauthorized content from any of these defendants prior to August 27, 2010, you can receive a cash reward of $10 or a refund of up to three months of content subscription charges from the Motricity class action settlement. In addition to paying out the class action settlement, the defendants are also required to adhere to certain consumer protection practices, including properly disclosing billing terms and promptly refunding authorized content.
Note: Participants in the AT&T, Mobile Messenger, Media Breakaway, m-Qube or Jamster! settlements are not eligible to file claims for the Motricity class action lawsuit settlement.
In order to claim either your cash award or subscription refund under the Motricity cell content settlement, you must submit a claim form either online or postmarked by January 31, 2011. Are there anymore lawsuits about this, because I got charged for it in 2011???
