KROGER BREAD CRUMBS SETTLEMENT UPDATE:
- The final hearing has been rescheduled for Jan. 24, 2021.
California residents who have purchased certain bread crumbs may qualify to make a claim for about $17.50 without proof of purchase thanks to a $780,000 Kroger class action lawsuit settlement resolving claims the product was falsely advertised.
The Class includes any California resident who purchased in California Kroger Bread Crumbs between Jan.1, 2010, and Dec. 31, 2015, for personal or household use and not for resale or distribution.
A Kroger class action lawsuit had accused the grocery chain of falsely advertising the Kroger bread crumbs as containing “0g Trans Fat.”
As of 2017, Kroger operated 321 food stores and 93 convenience stores in California under the Kroger, Ralphs, Food 4 Less, and QuikStop brands, according to the company’s website.
Kroger denies all accusations of wrongdoing, but has agreed to settle the case to avoid the risks and burden of continuing with litigation.
The Court has not ruled in favor of either party.
Class Members who submit a valid claim will receive a portion of the settlement fund after administrative expenses and other deductions are made.
Those who submit a claim without providing receipts as proof of purchase can claim an estimated $17.50.
Those who are able to provide receipts can claim up to $100.
Any unclaimed funds from uncashed checks will be donated to the American Heart Association. Kroger also has agreed to make a separate $21,000 donation to the organization.
A final hearing in the Kroger class action lawsuit settlement will be held Nov. 15, 2021.
The deadline to object to or opt out of the settlement is Sept. 20, 2021.
Claims must be submitted by Sept. 20, 2021.
