Kalispell Regional Healthcare has settled for $4.2M.

Kalispell Regional Healthcare has agreed to pay $4.2 million to resolve claims that they played a role in a data breach announced last year. The settlement provides several forms of relief including expense reimbursement, credit monitoring services, and cash payments.

The settlement benefits individuals who were notified by Kalispell Regional Healthcare that their personal information may have been compromised by a data breach announced in October 2019.

In October 2019, Kalispell Regional Healthcare revealed to their customers that cyber criminals had gained access to several forms of sensitive personal information. According to the healthcare company, the breach was achieved through an email scheme which allowed unauthorized users to gain access to Kalispell employee email accounts. The hackers were reportedly able to use this access to steal personal information.

Information accessed by the hackers reportedly included names, addresses, medical record numbers, dates of birth, telephone numbers, email addresses, medical history and treatment information, dates of service, treating physicians, medical bill account numbers, health insurance information, and even Social Security numbers.

Plaintiffs in the data breach class action lawsuit contended that Kalispell failed to protect their information, allowing hackers to gain access to the sensitive information. As a result, the plaintiffs and other consumers were allegedly put at risk for identity theft and other forms of fraud.

Kalispell has not admitted any wrongdoing in connection with the data breach, but has agreed to a $4.2 million settlement to resolve claims against them.

Several forms of relief are available under the Kalispell data breach class action settlement. Class Members will be able to collect up to $15,075 in reimbursement for expenses and lost time and can choose between five years of credit monitoring services or a cash payment of up to $100.

In order to benefit from the Kalispell data breach class action settlement, Class Members must file a valid claim form by Feb. 25, 2021. To recover reimbursement, Class Members must include supporting documents with their claims. Claim forms can be submitted online or can be printed, filled out, and mailed to the settlement administrator.

Class Members have until Dec. 11, 2020 to exclude themselves from or object to the Kalispell data breach settlement. Failure to take action will result in no benefit for Class Members while also relinquishing their legal claims against Kalispell. A final approval hearing for the settlement has been requested but is not yet scheduled.

Who’s Eligible

Individuals who were notified by Kalispell Regional Healthcare that their personal information may have been compromised by a data breach announced in October 2019.

Potential Award

Reimbursement for expenses and lost time along with credit monitoring services or an alternate payment.

Reimbursement of up to $15,000 is available to compensate Class Members for expenses related to the data breach. Additional reimbursement for lost time is also available. Class Members can claim up to five hours of lost time at $15 per hour.

In addition to reimbursement, Class Members can choose between five years of Experian’s credit monitoring services valued at nearly $720 and an alternative cash payment of up to $100. Exact cash payment amounts will vary depending on the number of Class Members who choose this option but will not exceed $100.

Proof of Purchase

Proof of losses connected to the data breach (receipts, bills, invoices, account statements, police reports, IRS documents, FTC identity theft reports, communications from banks, phone bills, travel expenses, and more).
