Gifted Healthcare agreed to a class action lawsuit settlement to resolve claims it failed to protect patient information from a 2021 data breach.
The settlement benefits individuals who received a data breach notification from Gifted Healthcare regarding a data breach in 2021.
Hackers allegedly gained access to sensitive patient data during a cyberattack that lasted from Aug. 25, 2021, to Dec. 10, 2021. Plaintiffs in the data breach class action lawsuit argue Gifted Healthcare could have prevented the breach by better protecting patient data with cybersecurity measures.
Gifted Healthcare is a travel nursing organization that helps nurses find jobs.
Gifted Healthcare hasnโt admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the data breach class action lawsuit.
Under the terms of the settlement, class members can receive up to $400 in reimbursement for ordinary data breach expenses, such as bank fees and credit costs. Class members can also receive up to $4,000 in reimbursement for extraordinary expenses, such as losses that occurred as a result of identity theft or fraud. In addition to this reimbursement, all class members are eligible for three years of credit monitoring and identity theft protection.
Class members who do not wish to receive credit monitoring or expense reimbursement can instead receive an alternate cash payment of $50 from the settlement.
The deadline for exclusion and objection is May 20, 2024.
The final approval hearing for the settlement is scheduled for Aug. 1, 2024.
To receive settlement benefits, class members must submit a valid claim form by Sept. 16, 2024.
