Georgia Cash America Inc. has agreed to a $36 million class action lawsuit settlement over consumer allegations that the company made improper Payday Loans and charged interest and fees on these loans at amounts higher than what the law allows.
Cash America does not admit any wrongdoing in agreeing to the class action settlement, but will provide to Class Members three times the actual damages they incurred as part of the settlement agreement. Actual damages include all the interest and fees that were repaid on the Payday Loan(s), subject to a reduction if the total number of valid claims filed exceeds the Maximum Settlement Fund amount.
The class action settlement also provides $25,000 each to Class Members James Greene and Mennie Johnson for their role and services as class representatives.
The only way to receive money from the Cash America class action settlement is to submit a valid Claim Form postmarked no later than Jan. 14, 2014. Detailed claim filing instructions are below.
The Final Fairness Hearing will be held on Jan. 16, 2014, where it will be decided whether to approve the settlement. In the event of approval, Class Members should receive settlement relief within approximately 60 days.
The Georgia Cash America Class Action Lawsuit is Greene, et al. v. Georgia Cash America, Inc., et al., Case No. 2004A7104-6.
Who’s Eligible
A Class Member is defined as all persons in Georgia who obtained a Cash America Payday Loan of $3,000 or less that was originated, marketed or serviced by, through or on behalf of Georgia Cash America from Oct. 9, 2001 with the following subclasses:
- All persons whose Payday Loans were originated, marketed or serviced by, through or on behalf of Defendants from the period of Oct. 9, 2001 through May 14, 2004;
- All persons whose Payday Loans were originated, marketed or serviced by, through or on behalf of Defendants on and after May 15, 2004; and
- Any other group(s) of persons the Court may deem necessary to define or distinguish.

April 30th gone, recording still saying same thing, no check, no letter. No update.
I received a check but my bank (Regions) states it’s fraud. Where can I cashed the check? I’m in Atlanta, GA.
Where can I “cash” the check? Sorry.
Open an account with another bank and deposit the check. The check cashier places will cash it but also charge a large fee. If it’s a large amount I would choose option 1.
haven’t received my check yet.sent paper work in before date line.
I am so glad I wrote the claim number down before mailing my form that way they won’t have any excuse and say that they never received it.
Call 1-888-430-2600 to see if you get a check, they received my paperwork but it appears I don’t qualify because Cash America didn’t submit my information about the loan for the lawsuit, nothing can be done
I called and was told that they did not receive my claim form. I mailed it to them as soon as I got it. I have also been following this case because I took out multiple loans. The lady ask if I sent it certified mail or had any type of proof that I mailed it? This really sucks and now I have been cheated twice!
I read on the FTC website and they said they busted Cash America and caught them shredding people loan accounts, said thousands.
rosemary we both experienced the same thing. i been following the site, mailed my paperwork and my sister paperwork. she got hers but they have no trace of my paperwork. I was asked as well did I send it certified. Of course not, I wasnt asked to send it that way. Looks like we all are cheated in this case.
