A $60 million settlement has been reached between the makers of the opioid addiction medication Suboxone and the Federal Trade Commission.

According to the FTC, Indivior Inc. and its subsidiary Reckitt Benckiser Group, conspired to prevent a lower-priced generic version of Suboxone from interfering with its significant pharmaceutical sales.

The settlement benefits all U.S. consumers who were prescribed Suboxone Film between March 1, 2013 and Feb. 28, 2019. The payout amount will depend on the number of total claims filed and how long the consumer was prescribed Suboxone film.

The FTC anticompetitive lawsuit notes that Indivior falsely marketed its Suboxone Film as being “less susceptible to accidental pediatric exposure than Suboxone Tablets,” right before a generic version of Suboxone tablets entered the market.

This misleading claim reportedly forced many consumers to switch to Suboxone Film which was the more expensive option.

The FTC states that Indivior even went so far as to submit a petition to the Food and Drug Administration in 2012 with statements that “Suboxone Tablets had been discontinued due to safety concerns about the tablet formulation of the drug.”

“In the midst of the nation’s opioid crisis, a critical opioid-addiction treatment was about to become more affordable,” said Gail Levine, a Deputy Director of the FTC’s Bureau of Competition. “But Indivior prevented that. It kept its drug prices high by unlawfully impeding generic manufacturers from competing effectively.”

The Suboxone lawsuit claims that Indivior engaged in improper business practices that didn’t allow competition thus violating Section 5 of the FTC Act.

Under the terms of the FTC settlement, consumers must file a claim no later than Dec. 1, 2020 to get a refund check.

Who’s Eligible

U.S. consumers who were prescribed Suboxone Film between March 1, 2013 and Feb. 28, 2019 are eligible to file a claim for this FTC settlement.

Potential Award

Varies. 

The payout amount depends on how long the consumer took Suboxone and how many claims are submitted overall.

Proof of Purchase

Not required at this time. However, consumers are encouraged to save any supporting documents in case the settlement administrator has questions later on.

    I filed a claim for myself and my husband back in Sept or Oct. After completing the form I called my friend on Suboxone to tell her about it. Well Friday she gets a check for $2300. I called and they are saying they have nothing for myself or my husband. I am so mad and wondering if there is anything I can do?

      With mail being so screwed up in so many places it may take a week or more to get the checks or card. I usually say after 2 weeks after people start getting checks then if I don’t get anything then I was not approved.

      I’ve been on Suboxone for many years too. I got the maximum reward $2563. The checks/cards were mailed out 5/10/2021. I received mine in 4 days. You can call the 800# listed on the claims confirmation email you received or look on the FTC website for it. The claims department can confirm the amount, your address, & date mailed. The young lady I spoke with was very sweet. However, they’re getting a lot of calls right now, so you may be in hold alittle while. I wish you all the best in your recovery.

      Has any one on here having any problems cashing there Suboxone claims center check at a bank I’m trying to cash mine at Huntington Bank and they still have it in hold and under review and not receiving there funds from the issuer bank

    Just got 2160.60 In Illinois took it to my Bank Midland and put it right in checking for immediate use. I did have enough to cover it but no problems at bank! Good luck everyone!

    IF Y’ALL HAVEN’T ALREADY REALIZED… THEY DON’T ALLOW YOU TO GET CASH OUT OF THE ATM & IT SAYS NO CASH BACK AT STORES…

    I WAS ABLE TO USE PAYPAL HERE TO HELP MY FRIEND GET MONEY OFF HERS!

    It let me charge 2 transactions so far, the first for $400 & the 2nd for $300
    We don’t really wanna risk running it again & locking it up or something but it let me charge it $700 within 5 mins if each other.

    BEWARE THOUGH… THE FEES ARE ABSURD!!! I was charged $24.80 by PayPal for accepting a credit card!

    Can anyone confirm they’ve actually gotten their prepaid card activated? If so, did you activate by phone or their website?

    If anyone has gotten their prepaid card activated, have you been able to use it at all?

    My best friend received a prepaid MasterCard for $2314.65 that she has not been able to activate online or by phone???

    I told her to give them a couple days before freaking out… it did say they sent out 14,663 prepaid cards totalling about 16 million so maybe their servers are having issues handling all the traffic to their site???

    My boyfriend & I both got checks in the mail today!
    My check was for $2563.92 – Chase has placed a 10 day hold on the funds

    My boyfriend hasn’t deposited his yet so not sure about his?

    I was told specifically that they were sending a check and low I get a card I cannot activate. Sounds to me they are not legit and we may need to consider a class action suit for lying to the consumers.
