A proposed Fontainebleau settlement resolves claims that the hotel failed to prevent a 2022 data breach that exposed personal information.

The class action settlement benefits all individuals in the United States impacted by the data breach, specifically those who received a notice of the data breach that occurred on or around Aug. 30-Sept. 2, 2022.

According to the data breach class action lawsuit, unauthorized access to Fontainebleau’s systems exposed customers’ personal information, including names, Social Security numbers and financial account numbers. Plaintiffs claim the hotel company could have prevented the data breach by implementing reasonable cybersecurity measures.

Fontainebleau Florida Hotel LLC is a hotel company with luxury hotels in Miami and Las Vegas.

Fontainebleau hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the data breach class action lawsuit.

As part of the Fontainebleau settlement, impacted individuals can receive reimbursement for documented out-of-pocket expenses incurred as a result of the data breach, as well as lost time, and access to identity theft protection and credit monitoring services.

Class members who experienced documented out-of-pocket expenses as a result of the data breach can receive up to $1,000 in reimbursement for these losses. The $1,000 reimbursement limit includes bank fees, communication charges, travel expenses, credit costs and up to four hours of lost time compensated at a rate of $25 per hour.

Victims of actual fraud or identity theft who experienced losses following the data breach can receive larger reimbursement payments of up to $4,000.

All class members are eligible to receive two years of free credit monitoring and identity theft protection. These credit monitoring services include real-time monitoring of credit files, dark web scanning, comprehensive public record monitoring, medical identity monitoring, identity theft insurance and access to fraud resolution agents.

In addition to providing these monetary benefits, Fontainebleau committed to information security improvements.

The deadline for exclusion and objection was Sept. 16, 2024.

The final approval hearing is scheduled for Dec. 9, 2024.

To receive Fontainebleau settlement benefits, class members must file a valid claim form by Oct. 31, 2024.
