Ferrara Candy Company agreed to pay $1.5 million to settle a class action lawsuit that accuses the business of discriminating against potential workers simply because they are African-American.
Plaintiffs Brian Lucas, Aronzo Davis, Torrence Vaughans and Maurice Milton filed the class action lawsuit on behalf of themselves and all others seeking employment at the Ferrara Candy Company, either directly or through two staffing agencies known as Labor Power and REM.
According to the lawsuit, the company limited or completely excluded African-American workers from being hired by Ferrara for positions of Machine Operator, Mogul Cook, Engrosser, Janitor, Quality Control Technician or Shipping Clerk.
The plaintiffs claim that they were steered away from available jobs at Ferrara by the staffing agencies who instead hired Latinos for those positions.
Ferrara, Labor Power and REM denied all allegations of wrongdoing but decided to settle the class action lawsuit to avoid the cost of further litigation.

The Ferrara Candy class action settlement is open to all Ferrara Direct Applicant Class Members and all African-Americans who sought a work assignment through REM or through Labor Power and were otherwise eligible to work at Ferrara but were not assigned or hired to work at the company between Feb. 27, 2009 and Dec. 22, 2015.

I contacted the Chicago courts I was told judge granted approval and granted attorney fees of 375.000 he didnโt see a thirty Day wait in the files call this number for your self and get the oil straight from the can call this number 312-435-5670 and they will need this case# 113-cv01525 . Any updates on this settlement TOPCLASS?
The minute entry on the docket states the following: โPlaintiffs renewed unopposed motion for final approval of the class action settlement agreement is granted.โ It also states that the attorneysโ fees petition was also granted. A status hearing is set for 3/16/17. The minute entry does not state what the reason for the status hearing is. It could be a final review of claim and payout details. So it looks like the settlement was granted final approval. There is now a 30 day period in which appeals can be filed. Claims will not be paid before this 30 day period is up. Weโll be watching for two things on the docket. First, the actual motion granting final approval, signed by the judge. This is not yet posted on the docket. The second, is to see if any appeals are filed. Because the motion for approval was unopposed, hopefully there will not be appeals filed.
I hope this information has been helpful. We will update the TCA article as soon as the final approval motion signed by the judge is showing on the docket. But, according to the minute entry, itโs finally approved!
