Fastenal has agreed to pay $1.3 million to resolve claims that consumers received credit card receipts which violated federal law.
The settlement benefits consumers who used their personal credit or debit card for a transaction at a Fastenal store between Aug. 22, 2016 and Sept. 6, 2018 and who received a receipt containing more than the last five digits of the card number and/or the expiration date of the payment card.
The Fastenal class action lawsuit claimed that the company wrongfully printed receipts for consumers which contained excessive information about payment cards. Allegedly, the information included more than the last five digits of the payment card’s number and information about the card’s expiration date.
According to the plaintiff, these receipts violated the Fair and Accurate Credit Transactions Act (FACTA). FACTA is a federal law which regulates the amount of information which can be included on electronically printed receipts.
The act aims to protect consumers from identity theft and fraud which may be perpetrated through disclosing sensitive payment card information.
Fastenal has not admitted any wrongdoing but has agreed to a $1.3 million settlement to resolve the FACTA claims against them.
Under the settlement, Class Members can collect a proportional share of the net settlement fund. Payments are capped at $1,000, but exact payments will vary depending on the number of valid claims filed and the net settlement fund after fees and costs are deducted.
In the event that funds remain after maximum payments are distributed to Class Members, any remaining money will be distributed to the Legal Assistance For Seniors charity.
In addition to providing payments to Class Members, Fastenal will implement a FACTA compliance policy reinforcing the changes they have already made to ensure that electronically printed receipts follow federal regulations.
In order to benefit from the settlement, Class Members need to file a valid claim form by Sept. 28, 2020. Claims can be filed online or printed from the settlement website and mailed to the settlement administrator. All claims must include proof of purchase, either a receipt or payment card statement showing the transaction at issue.
The deadline for exclusion and objection is Sept. 28, 2020. Exclusion will exempt Class Members from receiving payment from the settlement, but their legal rights to take action against Fastenal under FACTA will be preserved. Objecting to the settlement allows Class Members to dispute the terms of the $1.3 million deal but keep their eligibility for the settlement.
Class Members who fail to file a claim or exclude themselves – essentially doing nothing – will not receive any benefits from the deal and will also release their legal rights to take further action for the issue.
Preliminary approval for the settlement was granted by the court on March 11, 2020. The final approval hearing for the settlement is scheduled for Oct. 14, 2020. Payments will only proceed if final approval is granted by the court.
Who’s Eligible
Consumers who used their personal credit or debit card for a transaction at a Fastenal store between Aug. 22, 2016 and Sept. 6, 2018 and who received a receipt that contained more than the last five digits of the card number and/or the expiration date of the payment card.
Potential Award
Up to $1,000.
Payments will be distributed on a pro rata basis, but will be capped at $1,000. Actual payment amounts will depend on the number of claims filed and the net settlement fund after fees and costs are deducted.

An original or copy of the receipt or an original or copy of the credit or debit card statement showing the transaction.
