Dynamic Manufacturing Inc. has agreed to a $1,826,400 class action lawsuit settlement to resolve claims it unlawfully retained biometric information from employees and temporary employees.
The settlement class includes those who work or worked for Dynamic Manufacturing in Illinois as an employee or temporary worker who had biometric information collected and stored by Dynamic Manufacturing in connection with the company’s timekeeping software without previously signing a release between Feb. 3, 2016, and Dec. 27, 2022.
The plaintiffs claim the company obtained biometric data for its fingerprint time clock system and unlawfully possessed, collected, captured, stored, received, transmitted, converted or otherwise obtained or disclosed that data.
In coming to the settlement, Dynamic Manufacturing did not admit guilt and the company maintains it did nothing wrong. The court did not determine guilt in the case; instead, the settlement will end the case in order to prevent further legal costs.Â
If the court agrees to the settlement, the $1,826,400 will pay for all claims in the suit, including a service award of $5,000 for the class representative. No more than 35% of the fund will go to attorneys’ fees and court costs.
Members of the class must file a claim form to benefit. Each member of the class will receive a proportionate amount of the overall settlement based on how many claims occur.
If the court approves the settlement, payments will be made 28 days after the settlement receives final approval and the appeals process is complete. All payments will come in the form of checks, which will be void 180 days after they are issued.
The exclusion and objection date for the class action lawsuit settlement is May 22, 2023.
A final approval hearing has been scheduled for June 20, 2023.
