The Washington Metropolitan Area Transit Authority has agreed to pay $6.5 million to settle a class action lawsuit over allegations of racial discrimination in the employee background checks it used.

If you are an African American who failed WMATA’s background screening on or after Feb. 23, 2012 and were denied employment or terminated by WMATA or a WMATA contractor, suffering loss of employment or pay as a result, you may be entitled to compensation from the D.C. Metro class action settlement.

According to the D.C. Metro class action lawsuit, WMATA adopted a criminal background screening policy in December 2011 that allegedly adversely and disproportionately affected African Americans. The plaintiffs claim that WMATA’s background check policy violated Title VII of the Civil Rights Act of 1964.

WMATA denies the allegations and maintains that its background check policy was not discriminatory. However, it has agreed to settle the D.C. Metro discrimination class action lawsuit to avoid the burden and expense of further litigation.

In addition to providing cash payments to eligible claimants, WMATA has also agreed to change its background check policies for at least one year.

Class Members who would like to opt out of or object to the D.C. Metro discrimination class action settlement must do so no later than March 19, 2018.

Approximately 1,000 Class Members may be eligible for benefits from this D.C. Metro class action settlement.

Who’s Eligible

Class Members of the D.C. Metro discrimination class action lawsuit include African American individuals who were, at any time on or after Feb. 23, 2012:

  • Denied employment with WMATA, or were terminated or suspended from your position with WMATA, because you failed a background screening and Appendix A or C of the background screening policy; or
  • Denied employment with a WMATA contractor or subcontractor, or were terminated or suspended from your position with a WMATA contractor or subcontractor, because you failed a background screening under Appendix C of the background screening policy; or
  • Denied employment with a WMATA contractor or subcontractor, or were terminated or suspended from your position with a WMATA contractor or subcontractor, because you failed a background screening under Appendix F of the background screening policy.

NOTE: To qualify as a Class Member, you must have suffered a loss of earnings, employment or other damage as a result of the failed background screening.

Potential Award

$2,000 (estimated).

Class Members who submit short form claims will receive a flat payment that is estimated at $2,000. If you believe you suffered more than $2,000 in lost wages, you may submit a long form claim with documentation that supports a class action settlement payment of more than $2,000.

Proof of Purchase

Class Members must provide a Form W-9 and confirm that they:

  • Are African American;
  • Failed the WMATA background screening policy; and
  • Were denied employment, terminated, or suspended by WMATA or a WMATA contractor.

If you submit a long form claim seeking damages of more than $2,000, you must provide supporting documentation.

UPDATE 3 September 18, 2018: According to the settlement administrator, the settlement has been affirmed by the court of appeals.  There is now a waiting period to see if a petition is filed to the Supreme Court.  The next update will be on December 10, 2018.

    People don’t want to post on FB because these sherrifs on here are outrageous and attack people, meanwhile they have a have a faux profile and are just jealous they didn’t get a check,go figure. Everyone should blast these people for doing this and they should mind their own business! So upsetting, no one wants to post on FB , I surly don’t , they smear your name and repost your posts and wonder why no one wants to help anyone out on here q info

    Hey folks I’m in Maryland my wife received her check today for 27k I’ve been following this blog for a while my first post. I didn’t think she would get that amount she told me I am to negative. But she was right I don’t know what or why or how they determined the amount it was money we didn’t have yesterday and boy did we need it. I’m very thankful and for everyone that received money

    Who complains over a $14k check? There’s thousands of people being discriminated over their background and don’t get a CENT, but denials after denial.

    Does anybody who did a long form care that:

    1. All claims had to be submitted by March 7.
    2. The lawyers this past May told a Federal Judge that the class administrator approved over two hundred long forms of 22k and over 300 short forms for 2k
    3. That people who did long forms did not get 22k?

    I was approved for a long form and got a 14k check today.

    Can anybody logically explain how the monies are different from what was the lawyers told the judge, keep in mine at the time the lawyers told the judge this there were no more claims to be processed, the deadline had already passed. So what explains 8k missing off long forms?

    I intend on writing the Judge. I am a lawyer myself, and have no reason to lie here. Is there any real class member who has thoroughly read this and understands what I am saying?

      The settlement amount is on an individual basis based on wages lost. The 22k wasn’t a blanket amount like the 2k so if the documents provided did not support a 22k loss they adjusted for it.

      I did a long form and only got 14k I’m so mad how can they change amounts after How the motions sad that there a paying people an average of 22k for long I don’t understand. I am going to write the judge this is outrageous

        @Class Member. I put in for the long term claim as well and received 6k and I will take your 14k over my 6k any day. I don’t know how they determine who gets what but none of us had to secure a lawyer and the NAACP and the American Civil Liberties Union all fought for us to receive some type of compensation. Just pray on it. Spend it wisely and bigger blessings will come your way. God bless you.

          Thanks I just do not understand how attorneys can tell a judge their going to pay 1 amount then do not. I am grateful, I just think something is not straight.
