Chase Bank has agreed to pay $11.5 million to settle a class action lawsuit alleging the bank harmed credit card accountholders’ credit scores and even required them to pay on debts that were discharged in Chapter 7 bankruptcy.

The Chase credit card class action lawsuit alleged that the debts on Class Members’ accounts that were discharged in bankruptcy were sold to third parties, known as debt buyers; however, Chase failed to update accountholders’ credit reports. Instead, the credit reports reflected that the debts were sold or charged off.

The class action lawsuit claimed that Chase’s failure to update these credit card accounts reflected negatively on Class Members’ credit scores. Further, some Class Members, concerned about the affects of the allegedly falsely reported debt on their credit score, continued to pay on debts that had been discharged in bankruptcy.

Chase Bank says it did not attempt to collect on discharged debts, but has agreed to pay $11.5 million to end the class action lawsuit.

Class Members may be entitled to a full refund of any amount they paid on a Chase Bank credit card debt that was discharged in Chapter 7 bankruptcy, along with a portion of the settlement award.

The deadline to opt out of the class action settlement agreement is July 18, 2018.

Who’s Eligible

Class Members include “all individuals (i) who maintained a Credit Card Account with CBUSA; (ii) whose account CBUSA charged off and then sold to a Debt Buyer on or after January 1, 2008, and (iii) who post-sale sought and obtained a discharge of the debt as a result of his/her bankruptcy under Chapter 7 of the Bankruptcy Code, through and including the date of the Bankruptcy Court’s preliminary approval of the Settlement.”

Potential Award

A full refund of the amount paid on an affected Chase Bank credit card account, along with a share of the settlement award.

Proof of Purchase

      Not happening my friend, they keep prolonging it and once they past the deadline they will return the money back to Chase. Haynes is the most crooked company in the US they get a fee from Chase to make sure the money goes back to Chase. Call your Senators or State representatives and put in a complaint.

      Class counsel filed a notice with the court on 2/20/19 stating the pro rata payments of $438.75 will go out to 24,499 class members. The notice does not state how quickly claims will be paid, but hopefully soon!

    I advise everyone who is concerned about their refund to write your Congress Representative or Senator. Rust Consulting Inc. is hired by Chase/Court to distribute the money and the longer they keep the money without disbursing the better chance CHASE will have of not paying the full settlement.
