CaptureRx has agreed to a $4.75 million settlement to resolve class action lawsuit claims it failed to protect consumer data during a 2021 data breach.
The settlement benefits a nationwide Class of consumers who were notified by CaptureRx that they were affected by the February 2021 data breach. The settlement also includes a California Subclass of the same consumers who were California residents when the company notified them about the data breach.
CaptureRx is a third-party pharmacy management system that helps manage inventory, facilitate transitions, and other functions. Numerous pharmacies and hospitals around the country use CaptureRx to manage their systems.
However, patients of these pharmacies and hospitals may have had their personal information compromised in a 2021 data breach.
The data breach was first detected on Feb. 19, 2021, according to HIPAA Journal. A later investigation showed that unauthorized third parties gained access to sensitive data on Feb. 6, 2021. Affected clients were informed of the breach in late March and early April of 2021.
As many as 1.9 million individuals were affected by this data breach at hospitals and pharmacies serviced by CaptureRx. Patient information such as names, dates of birth, prescription information, and medical records was compromised in the breach, leading some patients to take legal action against CaptureRx.
In May 2021, an anonymous plaintiff took legal action against CaptureRx and Walmart, one of the companies affected by the data breach.
According to the plaintiff, the companies “betrayed” customers by failing to safeguard sensitive data. As a result of this failure, the plaintiff and other consumers allegedly face risks such as fraud and identity theft.
CaptureRx hasn’t admitted any legal wrongdoing but agreed to pay $4.75 million to resolve the allegations surrounding its 2021 data breach. According to Health IT Security, the company would consider bankruptcy if this settlement is not granted final approval.
Under the terms of the settlement, members of the national Class can recover a $25 cash payment.
Members of the California Subclass can recover an additional payment of $75, bringing their total recovery to $100. According to the settlement website, these payments could be increased or decreased depending on the number of valid claims filed with the settlement.
The deadline for exclusion and objection in the CaptureRx data breach lawsuit settlement is May 17, 2022.
The final approval hearing for the deal is scheduled for June 23, 2022.
In order to receive payments of up to $100, Class Members must submit a valid claim form by June 27, 2022.
