Consumers who purchased certain Canidae pet food products may be eligible to make a claim in a class action settlement, with or without proof of purchase.
The Class includes anyone residing in the United States or any of its territories who purchased one or more qualifying Canidae pet food products in the U.S. or any of its territories between July 9, 2016, and April 30, 2021.
A complete list of the qualifying Canidae pet food products covered by the settlement is available on the settlement website.
Plaintiffs in a class action lawsuit had accused Canidae of violating certain laws by labeling and marketing some of its products as “guaranteed” to be free of detectable levels of chicken or soy, when in fact, lab testing revealed the presence of those ingredients.
Canidae denies these claims, and the Court has not ruled in favor of either party.
Instead, the parties have agreed to a settlement to avoid the risk and expense of continuing with the litigation.
The company manufactures cat and dog food at its Texas plant, according to the Canidae website. A vet nutritionist assists in formulating Canidae’s recipes, which the company says contain no corn, wheat, soy, or animal byproduct meal.
Consumers who file a claim without proof of purchase, or who only have proof of purchase for less than $50, are expected to receive a single payment of $5 per household.
Those who submit proof of purchase with their claim will receive $5 for every $50 spent on the qualifying products with proof of purchase, up to a total maximum award of $125 per household.
Class Members may not submit both types of claim.
A final fairness hearing in the Canidae pet food settlement is scheduled for Sept. 13, 2021.
The deadline to opt out of or object to the settlement is June 14, 2021.
Claim forms must be submitted by July 29, 2021.
