Avis Budget Car Rental agreed to a nearly $34 million class action lawsuit settlement to resolve claims it failed to purchase liability insurance as promised in rental contracts.
The settlement benefits consumers who rented an Avis or Budget vehicle in Florida between June 12, 2008, and Jan. 1, 2016, and whose rental receipt included “SLI .00/Day Accepted” or “ALI .00/Day Accepted” notations. Renters who were involved in accidents and who have outstanding liability claims or whose liability claims were already paid are not included in the settlement.
Avis Budget Group is a car rental company that offers rentals under a number of brands, including Avis, Budget, Zipcar and more. These brands allow travelers to rent vehicles when they are away from home.
However, according to a class action lawsuit, Avis Budget failed to purchase the required liability insurance that it promised in rental contracts.
Plaintiffs in the case say that Avis promised to purchase a $1 million supplemental liability insurance policy from ACE American Insurance Co. to cover individuals who are not U.S. citizens and rented vehicles in Florida. Despite promising to purchase this coverage in rental contracts, Avis Budget allegedly failed to secure the policy.
Plaintiffs in the Avis Budget class action lawsuit argue the car rental company violated the terms of its contract and therefore violated Florida law.
Avis hasn’t admitted any wrongdoing but agreed to pay $33.9 million to resolve these allegations. The settlement helps all parties avoid the risks and costs of continuing to litigate through to a trial.
Under the terms of the settlement, class members can receive a cash payment based on the number of days they rented a vehicle from Avis.
Class members are estimated to receive between $6.51 and $7.46 per rental day based on the number of claims filed. Minimum payments of $6.51 would result in average payments of $87.32 plus interest, though exact payments will vary.
The deadline for objection is Oct. 22, 2022. The opt out deadline has already passed.
The final approval hearing for the settlement is scheduled for Nov. 10, 2022.
In order to receive a settlement payment, class members must submit a valid claim form by Jan. 20, 2023.

It’s unbelievable that Companies try and do get away with stuff like this .
Thanks Krista
Budget does not let you see your past rentals when you log into your account. They erase after a year which is wrong. Unless you kept a paper copy its hard to prove this claim.
So what do we do in this case scenario?
You file a claim and hope they have it recorded in their system.. Or you can assume if you file you will not get paid so it’s a matter of choice. If you do nothing that’s what you will get at worse a denial email if you do..
