TCPA class action settlement

Debt purchaser Asset Acceptance LLC has agreed to settle a class action lawsuit alleging it violated the Telephone Consumer Protection Act (TCPA) by using an automatic telephone dialing system, or artificial or prerecorded voice, to contact consumers on their cell phones without their consent. If you received a call on a cell phone from or on behalf of Asset Acceptance between April 17, 2009 and Sept. 4, 2014, you may be eligible for benefits from the class action settlement.

Plaintiff Ann Fox initially filed the TCPA class action lawsuit against Asset Acceptance in April 2013, accusing the company of violating the Telephone Consumer Protection Act by contacting her cell phone without her consent, thereby invading her privacy. She alleges these unwanted phone calls caused consumers to incur cell phone charges or reduced the amount of time they were able to use their cell phones under the plans for which they had already paid.

Asset Acceptance denies any wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the risk and expense of continued litigation. Under the terms of the class action settlement, Asset Acceptance will offer a total of $1 million in debt forgiveness and cash payments to Class Members who submit timely and valid claims.

UPDATE: On Mar. 31, 2016, Top Class Actions has updated this post to reflect the revised final hearing date, as well as information about the eligibility of Class Members that will receive a portion of the cash payout. According to the Asset Acceptance settlement website, more than 350,000 Class Members received postcard notices with inaccurate information. The Claims Administrator will be sending out revised settlement postcards to Class Members no later than April 6, 2016.

Who’s Eligible

Class Members of the Asset Acceptance TCPA settlement include all persons who were called using a dialer without consent on a cell phone by Asset Acceptance or someone acting on behalf of Asset Acceptance between April 17, 2009 and Sept. 4, 2014.

Potential Award

Up to $1,500. The actual amount each claimant will receive depends on whether the Class Member owes money to Asset Acceptance and the total number of valid claims that are submitted.

Of the $1 million Common Fund established by the TCPA class action settlement, $800,000 will be used for debt forgiveness and $200,000 will be paid in cash to Class Members who file timely and valid claims.

    I tried emailing as well, no response. They that could at least provide a monthly update on the settlement website or something! Its almost November…

      I haven’t heard anything either. I called last month and was told that they would be in the mail by mid-October at the latest. I tried calling them as well and nobody answered.

    Has anyone received any checks? I tried calling and emailing the case admin but I never receive a response.

    So, where are the checks?

      I just called and was told that even if someone only owed Asset $300 that they would only be awarded the one time debt forgiveness. That person would not get $1200 which would be the remaining balance of the $1500. The only people that will receive a check are the ones that do not owe any money. He could not explain why or where the difference would end up.

        Folks are not getting $1500 like they led us to believe. It’s now $36 (give or take a penny ) for those who paid off their debt.

    I just called them and was told checks will be going out as soon as today and up until mid October. She said anywhere between those dates and would not tell me exactly when. Also I asked how much will the checks be for and she claimed that information is not available and you will know when you get the check.

      I called in October and they said hold tight the checks should be going out by the end of November. I have a feeling this is going to be a run around game.

      The FAQs state that the settlement administrator will attempt to pay all claims within 90 days after the final ruling becomes final (approximately 8/1/16). Hopefully checks will be issued no later than the end of October. Keep checking Top Class Actions for updates. We will let our viewers know as soon as we learn that checks are in the mail!

        The end of October has passed TCA. When shall the participants expect the arrival of their checks. According to numerous filers no one is getting straight answers. Care to set folks straight? Thank you.

          No word on when checks will be mailed. Unfortunately, it may have be taking the settlement administrator longer than expected to review and process claims. We’ve had a few viewers report that they were told early 2017. Hopefully it will be sooner than later!

    Someone claimed on TCA’s Facebook page that they received $197. I don’t believe it, no picture of it. No one else has said anything either…

    It looks like they have until 9/30 to send payments. That will be 90 days after the final approval date.

      The settlement website states the following: “If the Judge grants final approval, and there is no appeal of the approval ruling, the ruling will become final by law in thirty days from the date of the ruling. The Settlement Administrator will attempt to pay all cash claims within 90 days of the date ruling becomes final so long as the individual amount of each claim can be determined.”. The court granted the settlement final approval on July 1, 2016. The ruling became final on approximately August 1, 2016. 90 days from the first of August is the first of November. Hopefully checks will be arriving sooner than later!

          No word on check amounts, but a declaration filed on June 27, 2016 states that as of that date there were 17, 409 valid claims. 5,422 were eligible for cash settlements and 11,987 were eligible for debt relief. That number may change based upon further review of responses to deficiency letters.
