State Farm has agreed to a class action settlement to resolve claims that they breached their Arkansas contracts by underpaying policyholders for their claims.
The settlement benefits individuals who made a claim to State Farm for loss or damage to a dwelling or other structure located in Arkansas based on a loss that occurred between May 1, 2010 and Dec. 6, 2013 and who received an โactual cash valueโ payment from State Farm for their claim.
After an insured property is damaged, insurance may provide benefits for policyholders in the form of cost reimbursement. Generally, policyholders are compensated with the โactual cash valueโ of their property.
Plaintiffs in the State Farm class action claim that the insurance company breached their Arkansas policies by wrongfully deducting the depreciation of labor costs for property damage. According to the State Farm class action, the depreciation deduction resulted in underpayment of claims.
State Farm has not admitted any wrongdoing in the allegations against them. The insurance company maintains that they did not breach the Arkansas insurance contracts and that claimants received all of the benefits they were entitled to. However, the company has agreed to a State Farm class action settlement to resolve the litigation.
The settlement provides varying levels of compensation for estimated unpaid labor depreciation, ranging from full 100 percent reimbursement to 10 percent reimbursement. In order to receive benefits from the settlement, Class Members must file a valid claim form by July 1, 2020. The deadline for exclusion and objection is May 2, 2020. The final approval hearing for the settlement is June 1, 2020.
Whoโs Eligible
Individuals who made a claim to State Farm for loss or damage to a dwelling or other structure located in Arkansas based on a loss that occurred between May 1, 2010 and Dec. 6, 2013 and who received an โactual cash valueโ payment from State Farm for their claim.
You are a Class Member in this settlement if you can answer โyesโ to the following questions:
- Do you or did you have an Arkansas homeowners insurance policy issued by State Farm Fire and Casualty Company?
- Did you receive an โactual cash valueโ payments, directly or indirectly, from State Farm for loss or damage to a dwelling or other structure located in the State of Arkansas, such payments arising from events that occurred between May 1, 2010 and December 6, 2013?
- Did your โactual cash valueโ payment include a deduction for estimated depreciation of labor?
Potential Award
Three groups of potential compensation:
- Group A: 100 percent of estimated unpaid labor depreciation plus interest at 5.25 percent per annum (for claimants who had estimated labor depreciation deducted but not subsequently recovered and who did not complete repairs in full)
- Group B: 75 percent of the estimated unpaid labor depreciation plus interest at 5.25 percent per annum (for claimants who had estimated labor depreciation deducted but only recovered part of the initially deducted labor depreciation and/or completed repairs in full)
- Group C: 10 percent of the estimated unpaid labor depreciation (for claimants who had estimated labor depreciation deducted and recovered all depreciation)

Information in State Farmโs records along with claimant documentation may be required to validate claims.
