UPDATE:

  • The AmeriGas pre-filled propane tanks class action settlement was granted final approval March 30, 2021.
  • Let Top Class Actions know when you receive a check in the comments section below or on our Facebook page.

Consumers who purchased AmeriGas or Blue Rhino pre-filled tanks may be eligible to claim up to $125 without proof of purchase as part of a $6.5 million settlement over the amount of propane in the tanks.

Those who are eligible to make a claim in this class action settlement include individuals who bought or exchanged one or more AmeriGas and/or Blue Rhino pre-filled propane tanks between Dec. 1, 2009, and Nov. 30, 2020.

Without proof of purchase, Class Members will be eligible for up to $2.50 per tank for up to 50 tanks, or $125.  Class Members who provide proof of purchase are eligible for up to $5 per tank, with no limit on the number of tanks that can be claimed.

This class action settlement resolves claims that AmeriGas and Blue Rhino allegedly colluded together to lower the amount of propane in their pre-filled propane tanks from 17 pounds to 15 pounds without also reducing the price, resulting in inflated prices for propane customers.

While consumers who purchased either AmeriGas or Blue Rhino propane tanks may be affected by this settlement, it only resolves the claims made against AmeriGas; the Blue Rhino case is continuing in court.

AmeriGas has agreed to end the litigation with this settlement, but AmeriGas does not admit to any wrongdoing.

The settlement agreement established two Classes.

The Indirect Purchaser Settlement Class is made up of those who purchased AmeriGas or Blue Rhino propane tanks, other than a wholesale purchase directly from AmeriGas or Blue Rhino for resale, in Arizona, California, Iowa, Maine, Michigan, Minnesota, Nevada, New Mexico, North Carolina, North Dakota, South Dakota, Utah or West Virginia during the Class Period.

The Direct Purchaser Settlement Class is made up of consumers nationwide who purchased one of the propane tanks directly from AmeriGas or Blue Rhino via a vending machine at retailers or other locations, or paid one of the companies directly through a vending machine to exchange a previously purchased propane tank, other than a wholesale purchase intended for resale.

A fairness hearing is scheduled for March 31, 2021.

The deadline for filing a Claim Form, opting out or objecting to the settlement is March 8, 2021.

I wonder why some ppl can call and get an amount but others can’t??? This settlement is ass backwards! I opted for digital payment thinking it would be quicker than waiting on a check but I was wrong! This is a 1st!

    1. Leelee says:

They could not give an amount yet as well. Maybe they just haven’t gotten to us yet.

  6. Tom says:

I called today and spoke to a very nice lady. She stated I was approved and I will be receiving an email this week to activate a digital process. I ask what amount was approved and she said $115.99. But I only claimed 24 tanks for the 2 years I had my grill.

  7. Leelee says:

I called today (07/26/2021) very nice young lady told me that I was in the system but they didn’t have an email address on file for me. So I gave it to her. She said electronic payments started going out today and I should receive an email. She had no information on how those electronic payments will be made.

  8. TONYA GILLIARD says:

TODAY IS THE 26TH HAS ANYONE RECVD DIGITAL PAYMENT…WAITING IN CT

    2. TB says:

    3. Tk says:

Nope. And calling or emailing them doesn’t help! All the emails regarding digital payments are the same! I think they dropped the ball in accounting!

  9. Leelee says:

I totally agree with you! My friend received a check for 241.65. Accounting had one job. LOL

  10. ButNotAsBAD AsTheORANGE says:

    Let’s hope “they” don’t audit U
like if U were part of the T.O.

After all, IF U do NOT report even
    your digital payments……Then do NOT
    run for public office !!!!
