AllSaints has agreed to pay $8 million to resolve claims that the fashion retailer violated the Fair and Accurate Credit Transactions Act by including more than the last five digits of payment card numbers on store receipts.

The settlement will benefit customers who made a debit or credit card purchase at an AllSaints location between July 29, 2014 and July 17, 2018, and were given a receipt that displayed more than the last five digits of their payment card and/or the card’s expiration date.

Plaintiffs Barbara Mocek and Miranda Varoz filed their class action lawsuit against AllSaints in 2016 alleging that AllSaints printed 10 payment card account digits on credit and debit card receipts. The plaintiffs claimed that this was a violation of federal law.

FACTA restricts the amount of information that is allowed on debit and credit card receipts in an attempt to protect consumers from identify theft. Under the law, expiration dates may not be printed on receipts and retailers can not include more than the last five digits of a card number on receipts. These regulations apply to all electronically printed receipts including those from cash registers, self-service kiosks, and restaurant bills.

“Unfortunately for customers, AllSaints’ knowing and willful disregard of FACTA’s truncation requirements exasperates the very risks that FACTA seeks to avoid,” the AllSaints class action lawsuit argued.

Under the AllSaints FACTA settlement, each Class Member will receive an equal share of the $8 million settlement after Class counsel fees and other expenses are deducted. Claims must be filed by April 1, 2019.

AllSaints has also agreed to implement regular reviews of their FACTA compliance policies in addition to the monetary awards available for Class Members.

Class Members have until March 18, 2019 to object to or ask to be excluded from the AllSaints class action settlement.

Who’s Eligible

Class Members include customers of AllSaints who made a debit or credit card purchase between July 29, 2014 and July 17, 2018, and were given a receipt that displayed more than the last five digits of their payment card and/or the card’s expiration date.

Potential Award

Consumers who file valid claims will receive an equal share of the settlement fund after litigation expenses are paid. In addition to providing monetary relief, the settlement also requires AllSaints to perform yearly reviews of its FACTA compliance procedures for the next three years.

    Anybody receive a tax form like a 1099-MISC or similar for the settlement payment? If so what is the payer’s EIN? I requested tax forms nearly a month ago but have yet to receive any.

      I think you only get the tax form if the settlement payment is above $599.

    So you went to BOA and they just cashed the check ? They didnt say it was a stop payment ? Do you have a BOA account ? If you have a BOA account they may take the funds out of it so keep an eye out for that.

      Not all checks had a stop payment placed on them, just the ones that were flagged.

      FYI for those who qualified and did not receive their check at the end of last year. I received an email back stating text would be sent out the end of April.
      When I did not receive my initial check, I emailed and called many many times. I was told my check was in the mail but it never came.
      So for those who are in the same situation ask me, hopefully your check will come at the end of April. I will update when I have received my check.

          Same here. Weird that the check didn’t come last year when everyone else received theirs. Check Date 4/22/2020. Received 4/28/2020 in San Francisco, California.

    Hi TK, I was out of town for few month working, came back and was pleasantly surprised finding nice check. Cashed with no problem. I just wanted to give you a suggestion : BBB and Consumer Protection Agency. They helped me in a past, bro. Also you can file court documents by mail, make sure you call clerk to verify they received it, and you have to provide notice to all attorneys – defendants and class counsel, because the7y have to know that you filing a motion, I think it calls Ex Parte, and it will be schedule for hearing. Its a hassle, and attorneys know that, that’s why they sided with Kurtzman Carson Consultants. One more thing, you can only file on your behalf, since you were never class representatives, and even if you ask to Subpoena information on people whos checks also got bounced, most likely they will deny this due to privacy, in best case – they will provide you with claims numbers which will be useless since some people could clear deficiencies. Good luck, you need it

        Any updates on this ?? Will the checks ever be able to be cashed or do we have to take a loss on the fees ? The checks are only good for 90 days and one month is gone already ??
