AdaptHealth agreed to a class action lawsuit settlement to resolve claims that it violated the Telephone Consumer Protection Act (TCPA) by contacting consumers with unsolicited spam texts.
The settlement benefits individuals who received more than one text message from AdaptHealth regarding CPAP supplies within a 12-month period, despite replying “stop” to an earlier message, since Nov. 23, 2018.
According to the telemarketing class action lawsuit, AdaptHealth contacted consumers with spam texts encouraging them to order CPAP supplies without first getting recipient consent. Plaintiffs in the case say these messages, which continued even after they opted out, violated the TCPA.
AdaptHealth is a health technology provider that delivers medical supplies, including CPAP products, to patient homes.
AdaptHealth hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the TCPA class action lawsuit.
Under the terms of the settlement, class members can receive a cash payment of $160.
The deadline for exclusion and objection is Nov. 21, 2023.
The final approval hearing for the AdaptHealth TCPA settlement is scheduled for Jan. 25, 2024.
In order to receive a settlement payment, class members must submit a valid claim form by Nov. 21, 2023.

Please add me. I have been with AdaptHealth for a few years now and have been thru this also. I also think they overbill me but have to check it out first.

I am getting calls 7 days a week all day long from market health place. Each number is from a different number and it is very annoying. They even call on sundays . What can I do to prevent rhese calls. I even block the calls. The call from different company names.
