The Reilly Foam Corp. reached a $150,000 class action settlement over its Illinois employees’ biometric information privacy.
The settlement class is made up of those who used a hand, finger or other biometric identifier or biometric information at a Reilly Foam Illinois facility between Aug. 1, 2017, and Aug. 1, 2022, and did not provide written consent in advance.
Reilly Foam was accused of violating the Illinois Biometric Information Privacy Act (BIPA), which requires any company that collects biometric information to follow specific procedures and receive written permission in advance to collect the data.
Reilly Foam is a company that engineers foam for thousands of consumer, medical and industrial applications. It has four manufacturing facilities with 450,000 square feet of manufacturing space across the country, including a Midwest office and plant in Naperville, Illinois.
Current and former Reilly Foam employees who used the finger scan should have already received information and a claim form related to the settlement.Â
Class counsel estimates claimants each will receive $650 after attorneys’ fees, administrative costs and other expenses are taken from the settlement fund.
Those who believe they are part of the class but did not receive a form with a claim ID should contact the settlement administrator at 833-602-5027.
The exclusion and objection deadline have passed.
A final fairness hearing in the settlement took place Oct. 4, 2023.
The claim form deadline is Nov. 18, 2023.
