Individuals who were affected by phishing incidents in 2017 and 2018 at ABM Industries may be eligible to take part in a class action settlement.
The Class includes anyone previously notified by ABM Industries of either the July 2017 phishing incident or the June 2018 phishing incident.
The plaintiffs had alleged ABM Industries was responsible for the incidents and accused the company of negligence, violation of California, Illinois, and New York law, and other violations.
ABM Industries denies all the claims made in the class action lawsuit, but has agreed to the settlement in order to avoid the uncertainty and expense associated with ongoing litigation.
The company provides facility solutions such as janitorial, HVAC, landscaping, electrical and lighting, among other services, to thousands of clients in various industries across the United States and more than 20 international locations, according to its website.
ABM Industries employs about 140,000 people.
Under the terms of the settlement agreement, Class Members are entitled to one or two years of credit monitoring, free fraud consultation, and identity theft restoration.
Class Members notified about one of the phishing incidents may request one year of credit monitoring in addition to any other credit monitoring they obtained from the company after the phishing incidents.
Class Members notified about both incidents may request two years of credit monitoring in addition to any other credit monitoring they obtained from ABM after the incidents.
The identity theft restoration, fraud consultation, and credit monitoring will be provided by Kroll Information Assurance LLC and includes alerts when a new line of credit is applied for under the Class Member’s name, unlimited access to consultation with fraud specialists, and access to a dedicated investigator who will work to uncover the identity theft’s scope and resolve it.
In addition, ABM Industries agreed to make improvements to its information security.
A final fairness hearing in the ABM Industries settlement is scheduled for June 22, 2021.
The deadlines to request exclusion from or to object to the settlement have passed.
The deadline to file a credit monitoring request form is June 7, 2021.
Who’s Eligible
Anyone previously notified by ABM Industries of either the July 2017 phishing incident or the June 2018 phishing incident.
Potential Award
Credit monitoring, identity theft restoration, and fraud consultation.
