TransUnion will pay $500,000 to end claims that it violated consumers’ rights under the Fair Credit Reporting Act by reporting on collection accounts with CashCall or Western Sky in states where the loan would have been void.

Class Members include those in select states who had their accounts reported by TransUnion as a part of a consumer credit report for loans originating from CashCall or Western Sky.

The laws in the following states may, according to settlement documents, make CashCall or Western Sky loans unenforceable: Alabama, Arizona, Arkansas, California, Connecticut, Florida, Georgia, Idaho, Illinois, Kansas, Maryland, Minnesota, New York, Oregon, Rhode Island, South Dakota, Virginia, and West Virginia.

Four plaintiffs alleged in the Cashcall, Western Sky TransUnion class action lawsuit that TransUnion had illegally included collection accounts for certain types of loans. They contended that including this information was a violation of their rights under the Fair Credit Reporting Act.

The Fair Credit Reporting Act, or FCRA, provides certain protections for consumers when it comes to their credit reports. A person’s credit, as shown through their credit report, is imperative to obtaining loans for housing and vehicles. Credit reports may also be pulled by prospective employers.

The content of a credit report includes other loans that have been made to the consumer, as well as whether the consumer has fallen behind or been sent to collections over a past due loan. The FCRA helps to ensure credit reports are fair and accurate.

According to the Cashcall, Western Sky TransUnion class action lawsuit, consumers in certain states were protected from having collection efforts from loans from CashCall or Western Sky included on their credit report. The complaint contended that these debts were invalid for a number of reasons, including that the debts had been forgiven.

TransUnion refused to admit any liability, but agreed to pay $500,000 to settle the Cashcall, Western Sky TransUnion class action lawsuit. Additionally, TransUnion has agreed to remove indication of collection efforts for CashCall or Western Sky loans on its reports to the best of its ability.

Class Members are estimated to include nearly 9,000 individuals in a variety of states. Under the terms of the settlement, most Class Members for whom TransUnion has a record of reporting CashCall or Western Sky collection claims will automatically receive $100. Class Members in California will need to submit a Claim Form with their Notice ID and 9-digit PIN to receive a cash award.

The deadline for Class Members to opt out of or exclude themselves from the Cashcall, Western Sky TransUnion class action settlement is Nov. 15, 2019.

Who’s Eligible

Class Members include “individuals identified by Trans Union, on or about July 2, 2019, as having inquiries on their file dated after October 12, 2016, with addresses in Alabama, Arizona, Arkansas, California, Connecticut, Florida, Georgia, Idaho, Illinois, Kansas, Maryland, Minnesota, New York, Oregon, Rhode Island, South Dakota, Virginia, and West Virginia at the time of the inquiries, that may have returned tradeline detail about a collection account where the furnisher identified the loan as originally issued by CashCall or Western Sky.”
