lyft unwanted text messages

Consumers have managed to secure a near $4 million settlement in a Lyft class action lawsuit alleging the rideshare company sent unwanted messages.

Washington residents who received an unwanted “Invite A Friend” text from Lyft between June 1, 2012 and Nov. 15, 2018, could get up to $132 from this class action settlement.

The class action lawsuit against Lyft claimed that plaintiff Kenneth Wright received a text from the rideshare’s “Invite a Friend” program. The text allegedly offered a $25 Lyft credit and urged the plaintiff to download the Lyft app.

The plaintiff said he never consented to receive the advertising and the unwanted messages cost him time, money, and data on his cell phone plan.

The Lyft texting class action lawsuit also alleged that the company violated Washington consumer protection laws as well as the Telephone Consumer Protection Act.

The Telephone Consumer Protection Act, or TCPA, was enacted to protect consumers like the plaintiff from unwanted or harassing telemarketing. The law, enacted in 1991, was expanded to include unwanted text messages. Fines under the TCPA are steep and can reach as high as $1,500 per violation or unwanted message.

Lyft agreed to settle the class action lawsuit in November 2018.

Under the terms of the settlement, Class Members are expected to receive between $3.30 to $13 per share.

Washington residents who received a text from Lyft’s “Invite A Friend” program before Feb. 9, 2015 and never accepted Lyft’s Terms of Service will receive 10 shares. Washington consumers who received a text from Lyft’s “Invite A Friend” program on or after Feb. 9, 2015 and accepted Lyft’s Terms of Service will receive one share.

Class Members can submit claims by mail or online. Class Members must provide either a Claim ID number or the phone number that received the unwanted text message.

The deadline for Class Members to exclude themselves or object to the Washington Lyft texting class action settlement is March 15, 2019.
