Chase Bank has agreed to pay $11.5 million to settle a class action lawsuit alleging the bank harmed credit card accountholders’ credit scores and even required them to pay on debts that were discharged in Chapter 7 bankruptcy.
The Chase credit card class action lawsuit alleged that the debts on Class Members’ accounts that were discharged in bankruptcy were sold to third parties, known as debt buyers; however, Chase failed to update accountholders’ credit reports. Instead, the credit reports reflected that the debts were sold or charged off.
The class action lawsuit claimed that Chase’s failure to update these credit card accounts reflected negatively on Class Members’ credit scores. Further, some Class Members, concerned about the affects of the allegedly falsely reported debt on their credit score, continued to pay on debts that had been discharged in bankruptcy.
Chase Bank says it did not attempt to collect on discharged debts, but has agreed to pay $11.5 million to end the class action lawsuit.
Class Members may be entitled to a full refund of any amount they paid on a Chase Bank credit card debt that was discharged in Chapter 7 bankruptcy, along with a portion of the settlement award.
The deadline to opt out of the class action settlement agreement is July 18, 2018.
Who’s Eligible
Class Members include “all individuals (i) who maintained a Credit Card Account with CBUSA; (ii) whose account CBUSA charged off and then sold to a Debt Buyer on or after January 1, 2008, and (iii) who post-sale sought and obtained a discharge of the debt as a result of his/her bankruptcy under Chapter 7 of the Bankruptcy Code, through and including the date of the Bankruptcy Court’s preliminary approval of the Settlement.”
Potential Award
A full refund of the amount paid on an affected Chase Bank credit card account, along with a share of the settlement award.

I just found the check from March 28, 2019. Can I still cash it?
I sent a post card to change my address and the card was returned to me. How can I change my address to continue to get checks?
So is this how attorneys get rich?????
“The court has allowed a further distribution from the settlement fund……please find here an additional settlement payment.” Wording on the letter arrived today (5/11/2020); check for $14.90
Key words….. “further distribution”…..dug through my records, the large payment $438 was approximately one year ago.
Every one got $400+ check why mine is only $14.90
I got a $400+ check AND one for $14.90. Kinda misleading when it says “A full refund of the amount paid on an affected Chase Bank credit card account, along with a share of the settlement award.”. It does say potential though.
Ahh, this was in addition to the $438.75. Part of the actual settlement. Hopefully the other part is next.

WGY IS THIS STILL HAPPENING EVEN AFTER IT SETTLED. HAD CHAP 7 IN 2018 AND THEY KEPT REPORTING PAST DUE LATE PAYMENTS ON CREDIT REPORT. NEVER RECIEIVED A NOTICE

WOW. I didn’t get my check so I will open an investigation cause seems like these Rusty and lawyers are profiting with others misfortune. ??. Please contact the judges…. they need to know about this issues.
I know how you feel Jim I’m still waiting on my check. I spoke with someone at the law office a couple months back and they confirmed I was indeed a class member and would receive a check soon as rhe judge released the funds. Still waiting albeit not very patiently. Keep wondering if it could be lost in the mail.
you should report it to the judge to open an investigation..,, seems like these rusty and lawyers are using others misfortune to profiting. ??. I never received a check or even confirmation of qualifying to be part of settlement. I tried to investigate but in vain . Website or phone number doesn’t give real options to be informed.
