A $675,000 settlement has been proposed in a class action lawsuit related to allegedly defective 35-watt and 50-watt solar tiles that are designed to replace roof tiles and provide solar power to the property. The solar tiles at issue were manufactured between 2008 and 2012.
If you purchased, installed or had Open Energy 35-watt or SolarBlend 50-watt solar tiles on your roof, you may be entitled to compensation from the solar panels class action settlement.
The Open Energy, SolarBlend class action lawsuit alleges the solar panels are defective. The solar panels at issue in the class action lawsuit are designed to blend in with the roof and replace traditional roofing tiles. This style differs from other solar panel products that are designed to sit on a rack on top of the roof.
The solar tiles covered by the proposed class action settlement include tiles sold under the brand names SolarSave or SolarBlend:

The defendants and cross-defendants named in the solar panel class action lawsuit include Centex Homes, Burlingame Industries Inc. d/b/a Eagle Solar, Suntech America Inc. (formerly known as Applied Solar Inc. and Open Energy Corporation), and SunPower Corporation.
The solar panel class action lawsuit asserts claims for strict products liability, negligent misrepresentation, breach of express warranty, breach of express warranty, and other violations.
This class action settlement does not cover Open Energy 34-watt solar tiles. Although these solar tiles look similar to the ones covered by this class action settlement, they were covered by a separate settlement.
The defendants have denied the allegations but agreed to settle the solar panels class action lawsuit to avoid the time, risk and expense of ongoing litigation.
Class Members who would like to opt out of or object to the solar panels settlement must do so no later than July 19, 2018.
Who’s Eligible
Class Members of the solar tiles settlement include anyone who purchased solar tiles, a property in which the solar tiles were installed, or otherwise have a financial interest in the solar tiles or their energy-generating capacity.

Potential Award
Up to $2,500
Proof of Purchase
Claimants whose information does not match certain records that are in possession of the Settlement Administrator may be asked to provide proof that Open Energy 35-watt or SolarBlend 50-Watt solar tiles were installed on the property.
