A $16 million settlement has been reached with North American Power & Gas in a class action lawsuit claiming that the company made false statements about its electricity and natural gas rates.

Several class action lawsuits claimed that North American Power & Gas (NAPG) made misleading statements about the company’s rates. In addition, plaintiffs allege NAPG’s rates were not based on market related factors or prevailing market rates as promised in their contracts to consumers.

The North American Power & Gas class action lawsuits alleged that after hooking customers with a low introductory “teaser” rate, the company then charged “exorbitantly” high premiums despite telling consumers that their rates after the teaser period would be related to prevailing market rates.

NAPG does not admit liability under the terms of the settlement, but has agreed to pay its electricity and natural gas customers in certain states $2.87 for each month that the company allegedly misled them about its rates. Customers of NAPG from Feb. 20, 2012 to June 5, 2017 may qualify for benefits under the class action settlement.

The deadline to opt out of the class action settlement is June 26, 2018.

I filed on 4/30/2018 but moved later that year. I have contacted the settlement administrator and spoke to Nicole and also left voicemails on 6 occasions to let them know I changed my address and that I never received a check and was told a supervisor would contact me. No one has contacted me.

Not anywhere near as much as the attorneys made on this deal. The disparity between their efforts and our out of pocket warrants a class action suit in and of itself.

  3. Alysia H. says:

I just received a settlement for $212 and some change. I was a customer with them for several years without noticing my bill was exorbitant and when I finally inquired qbout it, they told me my low rate had expired 2 years prior. I didn’t receive any notifications eventhough they said they sent letters and communication. I went back to ComEd and my bills have been much lower. I was glad to receive the $212+ but I spent way over and above that in error.

  4. Charlene Simmons says:

I was subject to NAPG variable rate for a number of years and just found out about the wrong rate and the class action suit. Please include me.

  6. Amanda Taylor says:

$2.87 for each month of service wouldn’t even reimburse me $100 of the $600 I overpaid. CMP was being accused and it was NAPG the whole time. I figured it out on my own after reviewing my bill for the 5th time trying to find any differences over the last year.
