FTC mailing checks from mortgage relief scheme

Chicago Title Insurance Company has agreed to settle a class action lawsuit alleging it charged too much for lenders’ title insurance policies in some mortgage refinance transactions.

If you refinanced a residential mortgage in Connecticut, you may be entitled to payment from the Chicago Title Insurance class action settlement.

Plaintiff Deborah Mahon filed the Chicago Title Insurance class action lawsuit in 2009. She alleges Chicago Title improperly failed to charge the discounted refinance rate for lenders’ title insurance policies in some residential mortgage refinance transactions.

Lenders generally require title insurance be purchased to protect a property in case a challenge to the title arises. They generally will not provide a loan to refinance a mortgage if the borrower does not have title insurance.

“For years, Defendant has reaped enormous profits at the expense of borrowers by engaging in a routine practice of charging them far in excess of Defendant’s statutorily-mandated title insurance rates,” Mahon alleges in the Chicago Title Insurance class action lawsuit.

“Misrepresenting to these borrowers that the inflated amounts being charged are correct, and failing to disclose to these borrowers that they are entitled to hundreds of dollars in savings when they purchase title insurance in connection with refinance transactions, Defendant knowingly and routinely has overcharged Connecticut borrowers for title insurance in violation of [Connecticut law].”

Chicago Title denies any wrongdoing but agreed to settle the class action lawsuit to avoid the burden and expense of ongoing litigation.

The Chicago Title Insurance class action settlement was preliminarily approved on Feb. 28, 2018.

Class Members who wish to opt out of or object to the Chicago Title Insurance settlement must do so no later than May 29, 2018.

Who’s Eligible

Class Members of the Chicago Title Insurance settlement include all persons who:

  • Paid for a lender’s policy of title insurance issued by Chicago Title and its agents in connection with the refinancing of a mortgage loan on a residential property in Connecticut from Jan. 1, 2000 to Sept. 26, 2006 and where the premises had been mortgaged within the previous 10-year period by a mortgage loan from a bank, credit union or other financial institution that was the primary loan used to purchase the property or to pay off all previously existing mortgages on the property;
  • Paid more than the discounted refinance rate under the applicable Chicago Title Company rate manual;
  • Had no intervening change in fee ownership of the premises since the prior existing mortgage (other than the addition or deletion of a family member); and
  • Whose current or former property address appears on the Class Mailing Notice List.
Potential Award

$150 unless the total amount of valid claims exceeds $200,000, in which claimants will receive a pro rata share of the settlement fund.
