Electricity supplier Palmco Energy NJ LLC has agreed to pay $4.5 million to settle a class action lawsuit alleging its advertising and sale of gas supply and electric generation service violated certain New Jersey statutes and regulations.

The New Jersey Attorney General’s Office, the New Jersey Board of Public Utilities and the New Jersey Division of Consumer Affairs filed the lawsuit against Palmco on May 23, 2014.

Palmco allegedly made door-to-door sales calls and telephone calls to solicit consumers into using its energy services. However, despite its promises, Palmco allegedly failed to provide competitive energy rates, rates that were lower than the utility companies, or rates that were consistent with pricing mechanisms in its contracts.

Consumers’ electricity bills reportedly skyrocketed during the severe winter of 2013-2014.

Palmco denies the allegations but agreed to settle the class action lawsuit to avoid the burden and expense of ongoing litigation. The proposed settlement reportedly provides up to $4.5 million in consumer restitution.

“Palmco portrayed itself as an affordable alternative for New Jersey consumers looking to lower their energy bills, but failed to deliver on its promises,” Acting New Jersey Attorney Christopher S. Porrino said in a June 23, 2016 statement. “Through this settlement, Palmco has agreed to significant revisions in its marketing and sales practices that are intended to ensure that consumers are provided with accurate disclosures as to pricing and are not misled.”

Under the terms of the Palmco settlement, Palmco has agreed not to engage in unfair or deceptive acts or practices related to its advertising and sale of natural gas and/or electricity supply services in New Jersey. The electricity supplier will also comply with all applicable statutes and regulations of the New Jersey Board of Public Utilities and the Division of Consumer Affairs.

The Palmco settlement also requires Palmco to change its business practices, and provides for civil penalties, restitution for consumers, and reimbursement of the State’s attorneys’ fees and investigative costs.

Who’s Eligible

“Polar Vortex Customers” and “Non-Polar Vortex Customers” may submit claims for Restitution Fund B by the deadline of May 15, 2018.

Polar Vortex Customers: Anyone who was a customer of Palmco during January, February and/or March 2014 and allegedly experienced overcharges by Palmco on their gas and/or electric bills.

Non-Polar Vortex Customers: Anyone who was a Palmco customer at any time up to and including the settlement’s effective date, other than during January, February and/or March 2014.

Potential Award

Palmco previously distributed $3.5 million from Restitution Fund A. However, eligible Class Members may submit a claim for restitution from the $1 million Restitution Fund B.

Proof of Purchase

Class Members must provide their Claimant Code (included on the mailed settlement notice) and supporting documentation such as advertising and marketing materials, a Palmco contract, correspondence with Palmco, and/or bills.

    This same company came to my house in PA and tricked my father into switching my bill even though my father has no authorization to do so they never contacted me

    I am a part of the B lawsuit haven’t received a settlement check yet they were supposed to be mailed out by July its August not a dime!!

    Palmco are still up to three old tricks, I see. I just switched from the company in Illinois because they promised a rate of .04. For 2 months they delivered but the third month it was .11 without any notice. My bill tripled. I have the contract and everything.

    I was contacted by phone in April 2017 by Palmco. They told me I would get a lower electric rate than the rate First Energy was charging me for the next 12 months. They told me their charge per kwh would be lower than the comparable rate that AEP lists as a compare rate on the electric bill. After two months Palmco started raising the charge per kwh, some months as much as double the comparable rate. I called Palmco in April 2018, request they discontinue being my electric provider. They called, left a message to contact them, I called back, was put on hold, hung up. I called back on 05/02/18, talked to their sales department. I expained what had occured, ask for a refund, was told he was unable to do that. I have copies of my electric bills. If there are any legal ways to recover these overcharges and get punitive damages from this company I want to be a pliantiff.

    Please add me. Have this company and going to cancel. ASAP. FALSE ADVERSTING. THEY GAVE ME A RATE OF 0.6 AND WENT UP TO 0.09 WITHOUT INFORMING ME. NOW MY BILL IS SKY HIGH. SUE THEIR A**!!!! DEFINITELY ADD ME

    I have PALMCO now and my bill around 300 and a little over is to much. They came to my door promise me one low rate and of 6.5 after I rece the energy the rate went up to .15. Should I cancel??

      I HAVE CANCEL THEN IN 2014. AND GOT THEM BACK IN 2017. AND THEY TRICK ME OUT OF MY RATES. LIKE I SAID THEY GAVE ME ONE RATE WHICH WAS FINE AND THEN SWITCH RATES TO A HIGHER RATE WITHOUT MY KNOWLEDGE. NO I HAVE TO PAY OUT ALL THIS ELECTRIC MONEY WHICH I DON’T HAVE.
      PLEASE ADD ME TOO.

    Im currently having this problem right now with this same company in Dayton Ohio. I signed up in December and have yet to see the difference my bill was current at that time and now its over $300. I jave not seen any thing on my bill that says palmco at all. If this come to Ohio i woukd love to be apart of it.
