M3 Financial Services has agreed to pay $600,000 to end a class action lawsuit alleging the company violated the Telephone Consumer Protection Act by using auto dialers and a pre-recorded message to contact consumers.
Those who received pre-recorded calls without consent from M3 Financial on their cell phones may be entitled to benefit under this settlement agreement. Calls covered by this settlement were made between May 12, 2011Â and May 26, 2016.
The class action lawsuit alleged that M3 Financial violated the TCPA by using an automatic dialing machine as well as a pre-recorded message. The plaintiff also alleged that these calls were unsolicited by those that received them.
The TCPA was enacted by Congress in 1991 to stop unwanted sales calls. Under the law, companies are proscribed from contacting consumers via phone or fax without their permission. Companies that violate the TCPA may face fines up to $1,500 per violation.
M3 Financial does not admit any liability under the terms of the settlement agreement; however the company will pay $600,000 to exit the class action lawsuit. Under the terms of the settlement, payment amounts to Class Members will depend on the number of claims submitted.
Class Members can object to the settlement or exclude themselves from it by submitting a written request no later than April 2, 2018.
Who’s Eligible
Class Members include individuals who received a call on a cellular telephone in the United States by M3 Financial Inc., using an automatic telephone dialing system or by an artificial or prerecorded voice message without their prior express consent from May 12, 2011 through May 26, 2016. There are about 19,385 Class Members.
Potential Award
After paying litigation costs, incentive payments and other fees, the remaining amount left in the $600,000 settlement fund will be divided equally among all Class Members who file a valid and timely claim.
Proof of Purchase
Class Members are required to provide the claim identification number (provided on their postcard notice) or cell phone number that received the call(s).

I went to check the class settlement website and the website no longer exists.
Did anyone receive a payout in this claim? I feel like we were duped.

Never go pay
It’s been two years folks, it’s not ever gonna pay out. I’ll tell you what I think happened. The fat, greedy, good for nothing attorneys realized that the company only agreed to pay 600,000 total. In their eyes, that peanuts, not worth the time. Especially since they are forced to give us, the people who ACTUALLY got called over and over by these people, at the very least a few pennies to make us feel like it’s worth it to keep filling these things out. It’s not. It’s just a money grab for the attorneys. All we are doing is making them millions. Stop doing these and they stop getting paid off of our suffering.
Any words on when this settlement will be sending out the checks for valid claims?
