CareCentrix employees whose personal information was exposed in a 2016 phishing attack can now claim benefits from a data breach class action settlement.
This CareCentrix class action lawsuit was filed in April 2017 by plaintiff Sarah Hapka, a former CareCentrix employee. Hapka alleged that her sensitive employment and tax information and that of other current and former CareCentrix employees was exposed due to a failure on the part of CareCentrix to take reasonable precautions with its employees’ information.
CareCentrix announced the data breach in March 2016. A phishing scammer posing as a CareCentrix employee tricked a CareCentrix staff member into handing over the 2015 W-2 forms for almost 2,000 current and former CareCentrix employees.
Hapka says that as a result of this attack, a fraudulent tax return was filed in her name.
CareCentrix sought to survey the proposed Class Members earlier this year, to determine whether Hapka was truly representative of the Class. U.S. Magistrate Judge Kenneth G. Gale denied the company’s request in August, finding that CareCentrix had failed to show the information it sought was necessary.
The CareCentrix class action settlement establishes a claims process by which qualifying Class Members who submit valid and timely claims can receive reimbursement for documented out-of-pocket expenses related to the data breach.
Class Members can also sign up for credit monitoring and identity restoration services at no cost to them.
Further, CareCentrix agrees to implement new security practices designed to protect its employees’ personal information. The new practices must be implemented for at least two years after the effective date of the settlement agreement.
Class Members who prefer to exclude themselves from the settlement or object to its terms can do so by submitting a written request by Dec. 29, 2017.
Who’s Eligible
Settlement Class Members include all current and former employees of CareCentrix whose personal information was compromised in the phishing scam data breach announced in March 2016.
The settlement administrator has sent notices of settlement to known Class Members. Persons who did not receive this notice but believe they qualify as Class Members can contact the settlement administrator to confirm.
Potential Award
Up to $5,000.
Class Members can receive up to $5,000 in reimbursement for validly documented out-of-pocket expenses related to the data breach. Qualifying expenses may include costs of credit monitoring or identity protection services already purchased, unreimbursed losses incurred as a result of identity theft, professional fees paid to address fraud or identity theft, and similar expenses related to the data breach.
Alternatively, Class Members who can properly document tax fraud can receive a payment of $200. Class Members who accept this payment will forego any other claims for out-of-pocket losses.
Class Members can also enroll in 24 months worth of free, three-bureau credit monitoring. Identity restoration services from Experian are also available.
Proof of Purchase
Claimants must provide documentation of qualifying out-of-pocket expenses. Valid documentation will be from a third party and will show specific and actual amounts paid by the claimant. Documents created by the claimant are not acceptable forms of documentation.
Claimants must include a verification stating that they believe the losses they claim are fairly traceable to the CareCentrix data breach and that the claimed expenses have not been otherwise reimbursed.
