Charter Communications Inc. and Charter Communications Entertainment I LLC have agreed to settle a class action lawsuit over allegations they failed to give credits to customers who experienced service interruptions that lasted more than 24 hours during certain severe weather events.

Massachusetts residents who did not receive a credit for cable television, telephone or internet service interruptions during certain weather events, may be entitled to a payment or credit from the Charter Communications class action settlement.

The cable outage class action lawsuit was initially filed in November 2011 by three Charter Communications customers who allege they suffered a loss of service during the 2011 Halloween nor’easter, also called “Snowtober” and “Storm Alfred.”

According to the Charter Communications cable outage class action lawsuit, Charter Communications should have provided credits to customers who experienced service interruptions that lasted for 24 or more consecutive hours caused by severe weather events. The plaintiffs claim Charter Communications failed to clearly, conspicuously and accurately disclose its refund and credit policies to customers in Massachusetts.

The Charter Communications defendants deny any wrongdoing but agreed to settle the cable outage class action lawsuit to avoid the cost and uncertainty of ongoing litigation.

The Massachusetts cable outage class action settlement was preliminarily approved on July 13, 2017.

The deadline to opt out of or object to the Charter Communications class action settlement is Oct. 23, 2017.

Who’s Eligible

Class Members of the Charter Communications cable outage settlement include current and former Charter customers in the Commonwealth of Massachusetts who experienced an outage of cable TV, telephone or internet services for at least 24 hours during one or more of the following time periods and did not receive a credit or refund for the outage(s):

  • May 31, 2011 through June 30, 2011 (tornado)
  • Aug. 27, 2011 through Sept. 26, 2011 (Hurricane Irene)
  • Oct. 29, 2011 through Nov. 29, 2011 (snowstorm)
  • Feb. 7, 2013 through March 6, 2013 (blizzard)
Potential Award

$21 for each outage.

Proof of Purchase

N/A. Class Members must provide the address at which they received cable service from Charter Communications and certify that they experienced a service outage that lasted at least 24 hours during the applicable severe weather event, and that they did not receive a refund or credit to their bill for the outage.

    This happens in Michigan ALL THE TIME ! Unless I call them and ask for a credit, they never willingly offer one. Ever.

    I also filled out the forms 1 for my mom and 1 for myself she received a check which did clear the bank ( I think ) but yet I never received 1 for myself …do they pick and choose who was eligible?

    I just received a $21.00 check from Charter which bounced. When I attempted to deposit it at and ATM it would not scan so I brought it in to a teller and it bounced within a week.

    Would an Attorney PLEASE file a lawsuit against COMCAST CABLE in Illinois for service outages that do NOT credit our accounts for the outage. We have had manyboutages per year ,and even though we call Comcast, we are not seeing any CREDITS on our bills for the outages.

    I believe I did receive a credit for the snowstorm of 10/29/11 thru 11/29/11 billing time period. When I called Charter no one could pull up my billing statements from that time period. What do I do now?
