JPMorgan Chase settles for $300 million

A class action settlement has been reached in the Chase Home Finance foreclosure class action lawsuit, resolving claims that JP Morgan Chase Bank NA provided improper affidavits during foreclosure proceedings.

Plaintiff Lisa Lovdal filed this Chase Home Finance foreclosure class action lawsuit on behalf of herself and other similarly situated Class Members claiming that the affidavits filed by Chase in various federal courts were allegedly signed by Chase employees who lacked “full personal knowledge of the information stated in those affidavits, including information indicating the borrowers’ indebtedness to Chase.” According to the Chase Home Finance foreclosure class action settlement, Chase Bank’s procedures for notarizing these affidavits is allegedly improper.

Lovdal and the Class further alleged that by providing these improper affidavits to several courts, Chase violated several federal and state laws. In the Chase Home Finance foreclosure class action lawsuit, the plaintiff brought several allegations against Chase including claims of common law fraud, breach of contract under the implied covenant of good faith and fair dealing, and violation of Ohio Revised Code by engaging in corrupt activity.

Who’s Eligible

You are a Class Member of the Chase Home Finance foreclosure class action settlement if:

  1. Chase brought a judicial foreclosure lawsuit against you in Ohio during the Class Period of  Feb. 18, 2006, until April 30, 2011;
  2. Chase filed an affidavit against you during the foreclosure lawsuit process before April 30, 2011; and
  3. The Chase foreclosure lawsuit resulted in a foreclosure judgment against you on Sept. 16, 2014 or before.
Potential Award

According to the Chase Home Finance foreclosure class action settlement, there is no cash payment for this settlement. However, the Chase settlement does provide certain benefits including:

  • No collection by Chase for any foreclosure deficiency judgment: Class Members’ debts will not be sold to a third-party debt collection settlement and Chase will not seek to collect any money from the foreclosure settlement Class Members.
  • No ability setoff by Chase: Chase has agreed to not seek money from plaintiffs and Settlement Class Members to be subtracted from any damages amount.
  • No collection by Chase of court and other costs: this includes court costs, attorney’s fees, pre-judgment and post-judgment interests stemming from a Chase foreclosure action.

    Barbara kirtom chase sold our account after a modification. We got 27000.00 from hardest hit fund. For qhat u owned the balance e would have about 3000.00 . Chase took 30000.00 doe lawyer fees that we only got a few motions thay file . Was never contracted about court. Ntryed ro make a payment sent it to chase thought that was where our loan was. Not and thay never sent it back or to other bank. We r homeless now my husband has cancer I have bad knees
    I went and looked at my old house and thay had some company come in and candy coat it
    It never did sell . It’s still in our name . I even payed 1000.00 to a company tojelp us figure it out . Thay had a hard time and said that thay was not doing no more. I hired a lawyer thought was a friend and he did nothing
    Recently he went to Mt husband and said I could have saved your.house. I want chase to pay us for our house
    We r both aer disable and on a limited budget cam I get help still.

    I am a victim of chase mortgage fraud scam gave control of my home to non family member pretending to be a deceased person niece and accepted forged power of attorney documents and this person was able to stop me from selling my house and other party was deceased she rented the house to tenants for over five years and stole all the money from 2013 to 2018 even though person was deceased this is the first time in my life that you can have power of attorney over a deceased person this is a disgrace and in justice the justice system is corrupt dishonest just like the home mortgage lenders lost home to fraudulent foreclosure.

    JP Morgan Chase did me a little differently, can I get help? They foreclosed in 2007, did not go to sheriff sale, let the property overgrow, I got fines from the city and had to quit claim the property to get the city off of me, JP sold off the note several times over the next years and I would get collection contacts, would dispute and never get reply till the next collector, l called and requested my file and was mailed the file of someone in Calif (l’m in Ok), in Oct 2019 the IRS sends me past due taxes from 2017 where JP filed 1099c debt forgiveness of which I was never told about, many hours and phone calls later they would not discuss it over the phone except that I did not get the 1099c because they didn’t know where I lived, “please send me, will do, pause, all set will take 7 to 10 days, ok where did you send that? To the 804 address, l don’t live there now for 12 years, do you have another address? What about the 12221, yes that is where l live I KNEW YOU HAD MY CURRENT ADDRESS!”, they send one page of the foreclosed property and many supporting pages from my then marital home that was by a different mortg com and settled 12 years ago and still no 1099c, I call back with more trouble on the phone and finally get a 1099c,,they did not follow any protocols and have commingled my account with someone from out of state- and my marital home, still owned the property, let it derelict, would not short sell prior to foreclosure for $20k of $25k owed, forged 3 appraisal signatures with no print or contact info for a $40k value when the county had devalued it to$15k, . . .all of this to start. I have supporting documentation for everything and can’t get to first base with the IRS. ANY HELP ? OR WHERE TO TURN? ERT

    I would like to know who to talk to about just finding out today after house was going to be sold that a Judgement for $29,700,00 was on my house from Chase & it was settled in 2011 so how do I get that off ASAP so my house can sell???? I really like to know is how come I never was notified by Chase or The Court that this even occured??? This isnt right.

    I too was cheated out of my home of 26 years due to denial of two loan modifications of which I was advised by them. Wells fargo got punished for similar actions

    Bayview, apparently the new Servicer for Chase sued me and I got foreclosed on just this week, but a bias judge. I have been trying to modify my loan for 6 years with Chase, spent $30,000 on lawyers and this week, they foreclosed on me. They refused my payments use Trickery, Deceit, Abuse and even have a Suicidal Hotline to hand out to upset customers. I personally am very diligent. My house was not upside down, i simply wanted to lower my payments. I was always on time, then I was told by Chase to miss a payment, then for 5 years between me and my lawyer were faxing hundreds and hundreds of dos every single month and they always denied me and never gave the reason. Never. They would make me start over again and again and even sent back documents that I had underlined and they said that wasn’t allowed and need to be highlighted with pink highlight. I asked the representative if she could just do that for me… she said no she has to send back to me and I have to do it again. I did everything right. I tried to pay my mortgage too and they refused my payments, every month putting Arrearage on my loan. Its absolutely criminal. I want to fight back. I have so much evidence as to the Abuse and deceit and the corruptness of them. I was not heard. I had a very unfair Trial. I want to fight back and win! I have owned my house for 25 years, my son is living with me and disable and the judge set sale date!

    Are you in this class action ? Call attys.1866-348-7646 I have been in Foreclosure hell with Chase also for years. Fight back . You will win!

    I contacted JP Morgan Chase my mortgage holder over a year ago for a loan modification . Since then they have denied me they tried foreclosure they tried to sale it at taxe auction . Also they denied payments . I’m still filling out papers every time they call me with another excess. I don’t want to loss my home . I have three boys and three girls and I don’t them to be with out . I don’t know what to do next . Can anyone help me? Thanks Joe Splechter.
