A settlement has been reached in a class action lawsuit alleging that Farmers Insurance Co. of Washington and Mid-Century Insurance Company failed to pay for “diminished value” losses under a policy’s comprehensive and collision coverage.
The Farmers Insurance class action lawsuit asserts that this failure to pay is a breach of the insurance companies’ automobile insurance contract.
If you were insured by Farmers or Mid-Century and received payment under your collision or comprehensive coverage for property damage to your insured automobile between Dec. 12, 2007 and May 1, 2010, you may be entitled to compensation from this class action settlement.
The Farmers Insurance class action lawsuit was initially filed in 2014. A trial was scheduled to begin on Oct. 3, 2016, but the parties negotiated a class action settlement before it started.
Farmers and Mid-Century deny any wrongdoing but agreed to settle the diminished value loss class action lawsuit to avoid the expense and uncertainty associated with continued litigation. The defendants have agreed to pay up to $10.7 million to Class Members, according to the settlement documents.
The class action settlement was preliminarily approved on July 29, 2016.
If you would like to object to the Farmers Insurance class action settlement, you must do so no later than Nov. 26, 2016.
Who’s Eligible
You are a Class Member of the diminished value settlement if:
- Farmers or Mid-Century paid to have your insured vehicle repaired under the collision or comprehensive provision of a Farmers Washington policy issued in Washington; and
- You received payment under your collision or comprehensive coverage for property damage to your insured automobile between Dec. 12, 2007 and May 1, 2010; and
- The repair estimate on your vehicle totaled at least $1,000; and
- Your vehicle was no more than six years old and had less than 90,000 miles on it at the time of the accident; and
- Your vehicle suffered structural damage and/or deformed sheet metal and/or required body or paint work.
Potential Award
Varies, depending on the Class Member’s vehicle repair costs. According to the settlement website, the average payment will be more than $500 per Class Member.
Proof of Purchase
You must provide the Claimant ID that was listed on the Claim Form that was mailed to you. It is printed below the bar code located in the upper left corner of the Claim Form.

Farmer’s of Columbus in Ohio not at fault driver here whom I see by this lawsuit could be a victim of their deceiving settlement as I was told by Farmer’s Claim adjuster they don’t pay. “Loss /diminished value” of one’s property caused by the found at fault driver!

was in not at fault accident, by a farmers insured driver and was also told they dont pay diminished value. my new car had a bent frame, had to get rid of it. farmers is horrible.
That would be easy to solve, if the other person was at fault, simply by suing them. If you lose out on the value of something like a car, due to lower value after it is fixed, your loss should be covered by themor their insurance, if you did not cause it. I’d never put up with that for that specific type of accident case.
