Bluestem Brands will pay $4.4 million to settle a class action lawsuit that accuses the company and its subsidiaries of violating the Telephone Consumer Protection Act.
Lead plaintiff Timothy Haight accused Bluestem Brands d/b/a Fingerhut, Gettington, and PayCheck Direct of using an automatic telephone dialing system to call cell phones in violation of the TCPA.
The Bluestem TCPA class action lawsuit further alleges that the robocalls were in connection with trying to attempt to collect debts owed on Fingerhut, Gettington, or PayCheck Direct credit accounts.
If you received an unwanted cell phone call without giving your prior express consent from Bluestem Brands and its subsidiaries between Sept. 11, 2009 and Nov. 15, 2014, you are considered a Class Member and can receive a settlement check if you submit a valid and timely Claim Form.
Bluestem denies that it did anything wrong but agreed to the terms of the TCPA class action settlement to avoid the cost of further litigation.
UPDATE: On June 13, 2016, the court granted final approval of the Bluestem TCPA class action settlement. According to the settlement website, claims will be mailed mid-August 2016. Keep checking back and let us know when you receive a check in the comments section below or on our Facebook page.
UPDATE 2: On Aug. 17, 2016, Top Class Actions viewers who submitted timely and valid claims for the Bluestem TCPA settlement started receiving checks worth as much as $7.04!
Who’s Eligible
Bluestem TCPA class action settlement Class Members include all individuals within the U.S. who received a non-emergency telephone call from Bluestem or on behalf of Bluestem to a cell phone through the use of an automatic telephone dialing system or an artificial or prerecorded voice in connection with an attempt to collect on a credit account debt from Sept. 11, 2009 through Nov. 15, 2014.
Potential Award
$20 – $30
Although it depends on how many Class Members submit Claim Forms for the Bluestem Brands class action settlement, both parties estimate that individuals should receive between $20 and $30.

Bluestem settlement Class Members must submit a valid Claim Form by May 16, 2016 to receive a financial payout. On the Claim Form, you will be asked to include the cell phone number that you received one or more robocalls from Bluestem Brands.

I received my $7.04 check and would like to Thank the Lawyers involved and the gentleman who filed the case.
Thank you very much.
I actually made my first payment even though my custom made sign was not spelled correctly.
They started HARRASSING me after I made my payment and before my next payment was due.
Obviously this did not inspire the confidence in me needed to be giving them my credit card number.
I also did not appreciate their nastiness during the holiday season and they actually sent my a garage sign that was worthless and really small.
Neverless the Holidays are coming again Let’s all make it a good one and try to shop from local Mom and Pop shops.
I got 7.05 check but now everyone i know is getting calls about me that i have no way how Gettington got the names of these people. Some are just casual aquaintances…they found my work number and are calling me at work. My dad died in January 2016 and before he died i had to have someone to come in while i worked and the expenses were overwhelming so i had to let some if my bills go on hold but i never intended to walk away..My privacy has gone out the window…these people are ruthless and will never get their money back acting like this.. The interest is so high on their merchandise i dont feel like they have really lost much.
