T-Mobile class action lawsuit

T-Mobile and Asurion have agreed to pay $4.2 million in order to settle a class action lawsuit that alleged the companies sold cellphone insurance to customers without fully disclosing details of the policy in violation of California law.

According to the T-Mobile and Asurion class action lawsuit, the insurance policy allowed Asurion to fulfill claims with refurbished phones, phones of a different make or model and phones that are worth less than the cost of the deductible.

Lead plaintiff Wineesa Cole filed the T-Mobile cellphone insurance class action lawsuit after trying to file a claim through Asurion. Cole claims that she was told that by purchasing the insurance policy for $3.99 per month, all she would have to pay is a $35 deductible if her cellphone was lost or stolen.

However, the cell phone insurance class action lawsuit claimed that when Cole lost her phone the insurance company informed her that she would have to pay $110 deductible or her cellphone could be replaced with a refurbished phone that could be worth less than the deductible.

Lead plaintiff Wineesa Cole alleges that T-Mobile and Asurion should be found liable of violating California’s Unfair Competition Law.

T-Mobile and Asurion deny any wrongdoing but agreed to the terms of the cellphone insurance class action lawsuit settlement in order to avoid the cost of further litigation.

UPDATE: The T-Mobile/Asurion cellphone insurance class action settlement is currently under appeal.  Claims will not be paid until all appeals are exhausted.  We appreciate your ongoing  patience. UPDATE 2: The appeals to the T-Mobile/Asurion cell phone insurance settlement were dismissed on November 15, 2016.  TCA Viewers reported receiving settlement checks in April 2017.

Who’s Eligible

The T-Mobile class action settlement is open to all Class Members who while residing in the State of California purchased cellular telephone insurance from Asurion through T-Mobile between Aug. 1, 2003 and Apr. 2, 2008.

Potential Award

Varies.

Class Members who submit a valid Claim Form will receive an equal share of the $4.2 million T-Mobile cellphone insurance class action settlement. The actual amount each Class Member receives will depend on the number of valid Claim Forms submitted.

Proof of Purchase

N/A.

T-Mobile class action lawsuit settlement Class Members are not required to submit proof of purchase. However, in order to receive financial compensation they must submit a valid Claim Form no later than Feb. 26, 2016.
