synovus bank overdraft fee settlement

A settlement has been reached in a class action lawsuit alleging that Synovus Bank charged illegal overdraft fees to banking customers. If you were a Georgia resident on July 30, 2010, held a Synovus Bank consumer deposit account that was opened in Georgia and were charged one or more overdraft fees between July 10, 2004 and Feb. 3, 2014, you could be eligible for benefits from the class action settlement.

Who’s Eligible

Class Members of the Synovus Bank overdraft fee settlement include all current and former Synovus account holders who were citizens of Georgia as of July 30, 2010 and from whom Synovus has collected, between July 10, 2004 and Feb. 3, 2014, at least one overdraft fee that was drawn from a Georgia account.

Potential Award

The Synovus Bank overdraft fee class action settlement will provide up to $16 million in payments to Class Members. Class Members who submit a valid Claim Form will be eligible for a full refund of all overdraft fees charged between July 10, 2004 and Feb. 3, 2014. If the total amount of overdraft fees from participating Class Members exceeds $16 million, each Class Member will receive a proportional share of the Settlement Funds.

Thomas Griner, et al. v. Synovous Bank, et al., Case No. 10-C-11235-3, in the State Court of Gwinnett County, State of Georgia.

Case Summary

The class action lawsuit was filed on July 10, 2010 by customers of Synovus Bank who claimed that the fees Synovus charged in connection with overdrafts arising from a point of sale or ATM debit card transaction constitute interest and, as a result, Synovus has violated Georgia’s usury laws and committed conversion. Synovus has denied any wrongdoing but agreed to settle the class action lawsuit to avoid the expense and uncertainty of litigation. The Synovus Bank overdraft fee settlement received preliminary approval on Feb. 3, 2014.
