A settlement has been reached in a class action lawsuit alleging Wells Fargo & Company violated the Fair Labor Standards Act and Illinois labor laws by improperly designating loan officers as exempt from overtime pay.
If you worked for Wells Fargo and/or Wachovia as a home mortgage consultant, mortgage consultant, and/or private mortgage banker in Illinois between Aug. 29, 2008 and March 26, 2011, you may be eligible for benefits from the class action settlement.
In August 2011, plaintiff Dylan Hoffman filed the Wells Fargo class action lawsuit on behalf of himself and other current and former loan officers who worked for Wells Fargo and/or Wachovia since August 2008. He accused Wells Fargo of violating the FLSA, Illinois Minimum Wage Law and the Illinois Wage Payment and Collection Act by improperly classifying loan officers as exempt from overtime pay.
Wells Fargo denies the allegations but agreed to settle the class action lawsuit to avoid the expense and uncertainty of ongoing litigation. The Wells Fargo class action settlement was preliminarily approved on Aug. 14, 2015.
Who’s Eligible
Class Members of the Wells Fargo settlement include all individuals who were employed as Home Mortgage Consultants, Mortgage Consultants and/or Private Mortgage Bankers in the state of Illinois between Aug. 29, 2008 and March 26, 2011 (excluding Loan Officers who opted-in to the multidistrict litigation action titled In re: Wells Fargo Wage and Hour Employment Practices Litigation).
Potential Award
$100 or more.
Class Members who do not file a Claim form will automatically receive a minimum payment of $100 unless they exclude themselves from the class action settlement. Class Members who file a Claim Form may be eligible to receive additional payment. The additional payment will be calculated according to a formula taking into account the time worked and the amount earned during the Class Period.
NOTE: Class Members should have received notice of this Wells Fargo class action settlement, along with a Claim Form, in the mail. If you lose, misplace or need another Claim Form, contact the Claims Administrator.
