Pekin Insurance agreed to a $12.45 million class action lawsuit settlement to resolve claims it failed to pay up to the policy limits for underinsured (UIM) or uninsured (UM) motorist claims.

The Pekin Insurance class action settlement benefits Arizona residents insured under a Pekin Insurance policy that contained uninsured and underinsured motorist coverage for more than one vehicle and who made a claim for this coverage between April 18, 2016, and Nov. 4, 2024.

Class members must have received a claim payment equal to the limit of liability for one vehicle’s uninsured or underinsured motorist benefits or who were one of multiple claimants on a single claim where the total payment was equal to the per-incident limit of liability for one vehicle’s coverage.

Plaintiffs in the case say that Arizona law requires multi-vehicle policies to provide separate coverage for each vehicle. This means that, in the event of an accident, policyholders should be able to “stack” their coverage and receive the policy limits for each vehicle covered by their policy.

Pekin Insurance allegedly failed to provide the required policy language and notice under Arizona law, leading policyholders to believe they could not stack their coverage.

Pekin Insurance has not admitted any wrongdoing but agreed to a $12.45 million class action settlement to resolve the allegations.

Under the terms of the Pekin Insurance class action settlement, class members can receive a cash payment based on the amount of uninsured and underinsured motorist coverage they had available at the time of their claim and the damages they suffered. Exact payment amounts will vary.

The deadline for exclusion and objection is Aug. 12, 2025.

The final approval hearing for the Pekin Insurance settlement is scheduled for Sept. 11, 2025.

No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive a settlement payment.


Who’s Eligible

The settlement class includes all persons insured under a policy issued by Pekin Insurance in Arizona that contained the uninsured motorist (UM) or underinsured motorist (UIM) endorsement and provided UM or UIM coverage for more than one motor vehicle, who made a claim for UM or UIM coverage between April 18, 2016, and Nov. 4, 2024, and who received a claim payment equal to the limit of liability for the UM or UIM benefits for one vehicle or who were one of multiple claimants in a claim related to a single incident, where the aggregate total paid on the claim was equal to the per incident limit of liability for the UM or UIM coverage for one vehicle.
