Details: The Vonage settlement will resolve a class action lawsuit, entitled In re Vonage Marketing and Sales Practice Litigation, that accuses Vonage of misrepresenting the scope of its promotional one-month free and money-back guarantee offers; of improperly collecting certain disconnection, cancellation or termination fees; and of continuing to charge subscription fees despite requests for cancellation. Vonage denies any wrongdoing but has agreed to pay $4.75 million to settle the class action.

To be considered a class member of the Vonage class action settlement, you must have subscribed to Vonage services on or before January 3, 2011 and were unable to receive a full month of free service, did not receive a full money-back guarantee under certain circumstances, were charged disconnection fees after cancellation, or paid for monthly service after requesting cancellation.

The proposed Vonage settlement provides four categories of relief:

Category 1 – One-Month Free Claims: Class members who were not able to receive a full free promotional month of service because the service began on the date their accounts were administratively opened and not the date full service was available for use are eligible to receive $10.

Category 2 – Money-Back Guarantee Claims: Class members who were not able to receive full service during the money-back guarantee period will be eligible to receive payment for any fees and charges they paid (refund not to exceed $25 for the monthly service fee and $80 for equipment charges) with submission of an eligible claim.

Category 3 – Disconnection Fee Claims: Class members who were charged disconnection, termination or cancellation fees for cancelling Vonage service and did not receive a refund or credit from Vonage will be eligible to receive payment for those fees (refund not to exceed $40).

Category 4 – Post-Cancellation Service Fee Claims: Class members who were charged monthly service fees after cancellation and did not use these services are eligible to receive payment for such service fees (refund not to exceed $50) with a sworn declaration.

In order to claim any of these benefits from the Vonage settlement, you must submit a claim form online or postmarked by July 9, 2011. (This date may be extended if the Final Approval of the settlement is delayed.)

I received my $10 check at the beginning of the month of March, 2012 and deposited it shortly thereafter. It was returned from my bank, SAFE FCU, stating the bank received a notice of non-payment from Vonage Settlement Administrator. Not only was the $10 deducted but an additional $15 for returned check fees was deducted from my account. As we were with Vonage for many years and was a very satisfied customer with an automatic deduction from my account on the 15th of each month (without fail), I find this unacceptable. If this is the practices exercised by Vonage, it explains why I received a $10 check!
