CIOX Health LLC, formerly HealthPort Technologies LLC, has agreed to a $1.25 million settlement in a class action lawsuit that accused the company of improperly charging fees for Missouri medical records.
The Class is made up of anyone who, on one or more occasions between June 9, 2009, and March 15, 2021, sought copies of medical records from the covered Missouri hospitals, or had the records requested by some other person pursuant to their authorization, and were charged e-delivery fees, no-records-found fees, and notary fees and who subsequently paid CIOX, either directly or indirectly, one or more of said fees and was not reimbursed by CIOX for the same.Â
Plaintiffs in a class action lawsuit had alleged the fees for Missouri medical records violated state law.
CIOX Health is a medical record copying service that contracts with healthcare providers throughout the state to maintain, copy and distribute the Missouri medical records of patients and former patients of these providers, according to the class action lawsuit.
The defendants have denied all allegations of wrongdoing, and the Court has not ruled in favor of either side in this case.
After attorneys’ fees, incentive awards, and other costs are paid from the $1.25 million settlement fund, Class Members will receive their payments.
Each Class Member who submits a valid claim form will receive a reimbursement of 29 percent of the portion of the covered fees they paid in connection with the Missouri medical records.
A final approval hearing in the Missouri medical records settlement is Aug. 31, 2021.
The deadline to opt out of or object to the settlement is July 13, 2021.
The deadline to file a claim is also July 13, 2021.
Who’s Eligible

Proof of Purchase
The claim form requires information such as invoice numbers and the amounts of the fees paid.
The settlement administrator may request additional necessary information in Class Members’ possession in order to validate their claims.
