Albertsons and other defendants have agreed to a $1 million settlement that will benefit certain job applicants for whom the company ran a background check.
Anyone who was subject to a background check obtained by Albertsons Companies Inc., Albertson’s LLC, Albertsons Companies LLC, New Albertsons LP, Albertsons Stores Sub Holdings LLC, AB Acquisition LLC, AB Management Services Corp., American Food and Drug LLC, Ink Holdings LLC, and/or Albertson’s Holdings LLC between Oct. 24, 2017, and Nov. 25, 2019, is considered part of the Class.
A class action lawsuit had alleged the defendants obtained background check reports on job applicants, in violation of the Fair Credit Reporting Act (FCRA) and certain state laws.
The FCRA is a federal law protecting consumer information reported to credit-reporting bureaus such as Equifax, Experian, and TransUnion. It also requires specific actions from employers running credit reports on job applicants.
Employers who want to pull a job applicant’s credit report must notify the candidate in writing as a stand-alone document. The document must notify the applicant that negative information in the report could cost them the position.
If the employer decides not to employ the applicant based on their credit report, they must notify the candidate of that decision and provide them with a copy of the report.
Albertsons Companies is one of the country’s largest food and drug retailers, according to its website, operating in 35 states and the District of Columbia.
The defendants deny all allegations of wrongdoing, and the Court has not ruled in favor of either party.
Payments to Class Members will vary. Everyone who submits a timely, valid claim form will receive an equal share of the settlement fund after attorneys’ fees and other costs are paid.
Class Members will have the option of receiving their payment via mailed check, PayPal, or digital check or direct deposit to their bank account.
A final fairness hearing will take place June 11, 2021.
The deadline to opt out of or object to the Albertsons settlement is April 30, 2021.
The deadline to submit a claim form is also April 30, 2021.

Anyone who was subject to a background check obtained by Albertsons Companies Inc., Albertson’s LLC, Albertsons Companies LLC, New Albertsons LP, Albertsons Stores Sub Holdings LLC, AB Acquisition LLC, AB Management Services Corp., American Food and Drug LLC, Ink Holdings LLC, and/or Albertson’s Holdings LLC between Oct. 24, 2017, and Nov. 25, 2019.
