Fox News death lawsuit overview: 

  • Who: The parents of deceased Ukrainian journalist Oleksandra Kuvshynova filed a lawsuit against Fox News Network LLC and its founder Rupert Murdoch, among other related entities.  
  • Why: Kuvshynova’s parents claim Fox News was negligent and reckless on the day of her death and allegedly have sought to shift blame for what happened in its aftermath. 
  • Where: The lawsuit was filed in the Supreme Court of the State of New York, County of New York. 

Fox News caused a Ukrainian journalist’s death, a new lawsuit filed by the journalist’s parents alleges.

Plaintiffs Andriy Kuvshynova and Iryna Mamaysur’s lawsuit claims the March 2022 death of their daughter, Oleksandra “Sasha” Kuvshynova, was the result of negligence and recklessness on behalf of Fox News. The 24-year-old journalist was killed after the car she was in was hit by an explosive.

Andriy Kuvshynova and Mamaysur argue Fox News also engaged in a scheme to cover up the incident so as to “deceive” both them and the “public concerning Fox’s alleged wrongdoing that caused Sasha’s death.” 

“Unknown persons acting as employees and agents of Defendants Fox and HarperCollins produced a misleading account of Sasha’s death to conceal Fox’s responsibility for the alleged wrongdoing and to deceive Sasha’s parents and the public,” the Fox News lawsuit says.

In a statement to Top Class Actions, Fox News Media says it will respectfully defend against the inaccurate claims within the lawsuit.

“We understand the grief and continue to mourn the loss of both Pierre Zakrzewski and Sasha Kuvshynova …” the statement says. “The safety of our journalists has always been our No. 1 priority. We are immensely grateful to the Fox News reporters who have covered the war in Ukraine and we remain committed to reporting from the region.”

Fox News lawsuit: Network attempted to shift blame for incident that led to Ukrainian journalist’s death

Andriy Kuvshynova and Mamysur claim Fox News tried to shift the blame for the attack to co-plaintiff Shane Thomson — a security advisor contracted with Fox News — despite Thomson allegedly advising against going to the area where the incident took place. 

The lawsuit claims Fox News’ sister Murdoch corporation and co-defendant HarperCollins also published a “misleading account” about what happened that was authored by reporter Ben Hall, who was injured during the incident but was ultimately evacuated and saved. 

Andriy Kuvshynova, Mamysur and Thomson claim Fox News is guilty of wrongful death, fraud, intentional infliction of emotional distress, defamation, and tortious interference. The plaintiffs demand a jury trial and request an award of punitive damages. 

Another class action lawsuit filed against Fox News last year over claimed the company harmed shareholders by knowingly promoting the false narrative that the 2020 presidential election was stolen from Donald Trump.
