What Rights Do I Have as a Class Member?
If you received notice that you are a Class Member of a class action lawsuit or settlement, your legal rights are affected. It’s important to be aware of your rights and legal options to make sure you get the best outcome for your circumstances.
Opt In
In most class action lawsuits, eligible individuals are automatically included once a judge grants Class certification. However, some class action lawsuits require Class Members to opt in to be included in the Class. Read the notice carefully to find out what steps are required for you to take to participate in the class action lawsuit.
Opt Out
If you don’t like the terms of a settlement or you think you may pursue legal action against the defendant for the same issues that are at issue in the class action lawsuit, you can exclude yourself from the litigation.
If you opt out of the class action lawsuit, you will no longer be eligible to receive any benefits that may become available following a settlement or trial outcome. However, you retain the right to file a future lawsuit against the defendant over the same issue.
The process for opting out of a class action lawsuit or settlement typically involves submitting a written request to either Class Counsel or the Settlement Administrator. Instructions on how to submit an exclusion request will typically be included on the Class Notice and/or class action lawsuit website.
Object
You can also object to a class action settlement if you feel the terms are unfair to the Class. Filing an objection allows you to inform the court and the parties about your concerns. A judge must consider all objections that were filed by the deadline before granting final approval to the settlement. If the judge finds that an objection has merit, the settlement may be rejected or the judge may order the parties to renegotiate parts of the settlement.
Attend the Final Fairness Hearing
Class Members also have the option of attending the final fairness hearing. During this hearing, the judge will consider any objections and make a decision about whether to approve the settlement. You may ask the judge for permission to speak at the fairness hearing. Read the notice carefully to find out how to notify the judge that you intend to appear and the date by which it must be filed. Class Members are not required to attend or speak at the final fairness hearing.

But what about those of us who don’t want the class administrators to have our contact details? What if we don’t want our names added to the “List of timely exclusions”? Some of us want our data removed completely and forever from the case.
Most of the time we want this because we never purchased the product or service cited in the case. This happens to me all the time. I never did business with Coach, GNC, Walmart, Capital One, or half the defendants being cited in the various cases where my name, email, or other data appeared. Other times, I did not even live in the USA during the period cited in the case, and the settlement agreement clearly states that the case only applies to US residents. My name did not belong on the case at all. I am not entitled to the $6 payout.
I typically write them back sending the class settlement administrators on a “wild goose chase”. I guess Angeion Group has sent a dozen $6 checks to “Stinky Cheese” at the address of a water tower over the years. They leave me no alternative. How else can I get my name and address removed 100%? Masking it with a fake name and address is my only choice other than threatening to come and remove my data forcibly.
Just to let you know, in years past (late 90’s early 00’s), I filed claims, and when I saw that the checks were less than the cost of taking them to the bank (say $2) I tossed them in the shredder.

if any ,if your going to do a civil lawsuit, your information would be out there..I would hope so, if any, to make them know it’s not right to defraud, or lie or anything to the above, it about just really scared my son what happen to us, and i have three Grown boys…and my middle son ,is still bothered, because i always tell him, when you know your civil rights are violated you have to stand up…and face the people who did what they did ..so your life will be right again..

There is no claim form available for this settlement. There is an opt-out option. The settlement calls for injunctive relief only, and no payment to class members. After fees, the remainder of the settlement fund will be donated to charity.
