What is an open settlement?

An open settlement is a class action settlement accepting claims from eligible class members. The Top Class Actions team scours the Internet each week looking for open class action settlements that pay cash and offer other benefits to consumers and place them in one convenient place on our website, under the Open Settlements heading.

When does a settlement administrator start accepting claims?

Settlements are reached when the parties in a class action lawsuit decide it is in their best interests to put an end to the litigation. The costs of litigation can be expensive and consume a great deal of time and energy. A class action settlement allows a defendant to exit the litigation without admitting any guilt or wrongdoing.

After the settlement agreement is reached, the parties submit it to a judge for approval. The judge will decide whether to certify the class and preliminarily approve the deal or reject it.

In most cases, the claim-filing period opens after the judge grants preliminary approval to the settlement, and that period will remain open for a specified length of time. Depending on the type of settlement, the claim-filing period may remain open for just a few weeks or it may remain open for several years.

    What do you do if you qualify for settlement, but the settlement company keeps denying your claim even though you have sent every proof they have required? When i contact Kitec Plumbing for claim status, they keep telling me they misunderstood the claim and believed we did not pay out of pocket although i have sent them copies of the cancelled check.

    My neighborhood was part of a class action suit against Coronet industris i been living in my home since 1982. I never filed my paper work back in 2003-5 can I still receive part of the settlement?

    i have filed out the form for nexium and haven’t gotten any word on anything im not sure if i filled it out correctly or not? And when i look in the followed section i dont see anything updated to any of the articles that i entered into that section.I had a big deal with the doctors taking me off prilosec because of the weak bones,high blood pressure & changes in blood sugar.

    I’m still waiting for the Jc pennies payout. Settlement is over and I haven’t received a check in the mail.

      Unfortunately, no updates on when JC Penney checks will go out. Here is the TCA article with the JC Penney fake sale settlement details and our latest update: https://topclassactions.com/lawsuit-settlements/closed-settlements/329427-jc-/penney-fake-sale-class-action-lawsuit-settlement/. The court granted the settlement final approval on 9/30/16. An appeal to the settlement was filed on 10/7/16. The appeal was dismissed on 11/7/16, which is good news. No word on when claims will be paid. There was a very extensive claim review and audit process, and the settlement administrator may still be working through that. Please keep checking Top Class Actions for updates. We will let our viewers know as soon as we learn that checks are in the mail!
